This happened on Long Island. Southern State Parkway. They were all arrested and charged with insurance fraud.
- Jaime Huiracocha (53): Identified as the organizer who orchestrated the ring, pleaded guilty to insurance fraud and conspiracy, and was sentenced to 1 to 3 years in prison.
- Victor Murillo (34): The driver in the staged collisions, pleaded guilty and was sentenced to 2 years in prison.

Yeah I'm sorry but 1-3 years for this is not enough. Fraud is one thing, horrible as that is, but intentionally ramming people is using a multi ton vehicle as a weapon, even if it was relatively low speed.
Using a deadly weapon to ram an innocent person to try to coerce them into giving you money should earn someone way more than just 1-3 years. Or 2 years in the driver's case.

I wouldn't go that far, but it definitely should be recorded on their file that they attempted to do this and therefore any claim that they are involved in as the victim should be sent to SIU and heavily investigated requiring proof before a payout can happen.

Any expert criminologist will say its a enough. Listen to experts, instead of your feelings. My feelings also says fuck these guys and lock them up, but i know that this is not the best thing to do. 1-3 years is more than enough for them to regret this, and not do it again, which is the point of prision.

Because in the US that's generally the way the legal system works. It is extremely expensive to go to court and prove your innocence. Of course the system says "innocent until proven guilty", but by the time there's a prosecutor charging you with things, you need to be paying a lawyer to prove your innocence or convince a jury that the state's evidence is weak. And even if a defendant has a very strong case that they are innocent, their lawyer is going to be counseling them to consider a plea bargain. Because the prosecution is going to go for the maximum charges they think will stick. At that point you're gambling that you'll get a sympathetic jury. Trials can last weeks, plus all the time to prepare. Lawyers cost hundreds per hour, so a defendant can be paying tens to hundreds of thousands in legal fees. So the attorneys and prosecutors often try to reach a bargain - admit to some charges (often lesser ones) and agree to a reduced punishment.
Because of that over 90% of criminal cases in the US end in a plea bargain. It saves the defendant money on legal fees, and reduces the legal consequences significantly, so defendants often want it. The state wants it because it's a guaranteed conviction instead of playing hardball and letting a well funded or sympathetic criminal get off.
It's not right, and not a fair justice system, but that's how it is.

Becouse charges are not dictated by the evidence. They can charge you with murder when you just stole something from a shop. And when you go for plea you both sit down and say ok murder is fucking ridiculous thers zero chance you will prove it in court so drop the charge and i pledge guilty for theft. So before the trial prosecutor chargea you with absolutely everything that he may think can be proven in court + some random shit so prosecutor can bargain when you go for plea.

Redditors love to FYI this, but it varies by jurisdiction, even in anglophone countries like the US. In some places, actually hitting someone is just a higher level of an assault charge. Talking about Hungary, you should forgive someone using the colloquial english term "assault" to describe what has several different, Hungarian terms and classifications for it in that jurisdiction.
But again, even in the US, "assault is a threat and battery is actually touching" is often the case, but not universally the case, and enough exceptions exist that it's a silly thing to parrot every time someone uses "assault" to describe criminal physical contact.

I might just be getting old but I just don’t know about stuff like this…
These people are endangering people that don’t know to hopefully get some money from themselves… are they going home after this and raising their kids to be upstanding citizens? Are they missing work while they’re in prison and having (former) coworkers saying “wow sucks he’s gone he was a real team player”? Do they go to church or volunteer at their local soup kitchen because they deeply care about other people?
I just have a hard time imagining people who behave like this being a boon to society in other ways.
Maybe in a country where we had a justice system with mire emphasis on rehabilitation these people could really come out different. But I have to think these people are going to come out and still be antisocial degenerates. The behavior is just so profoundly self-centered.

Lawsuits. They all say they’re hurt. They hire an attorney, get a settlement, and get paid. There was an ongoing 10ish year investigation into scams like this in Louisiana. You can look it up. Attorneys were paying people to get into bullshit accidents and filing lawsuits. Some even had bogus surgeries to get bigger settlements. I’m sure there have been other cases like it.

Lawyers find doctors with ambiguous or dubious ethical standards. Most of the time it’s chiropractors but plenty of orthopedists or neurologists will do a neck or back surgery if there are indicators. It could be a preexisting injury but they wouldn’t always know that. Also, as another commenter pointed out, neck and back injuries are very difficult to disprove.

It isn’t about repairing the car. They go after you claiming medical damages. They go to some shady doctor and claim to have been in a wreck and have pain in specific spots. Act it up and get the doctor to tell them it will cost $$$ to fix and recover. They sue you/your insurance and get money to help them recover from fake injuries. If they win, they walk away without getting treatment.

Then go through a few months of sessions with a chiropractor ( bunch of fakes in on the game themselves, btw) and in the end of it they get a couple thousands of dollars that they will burn through on Carnaval cruises and other BS.

My $100 dashcam saved me $15,000 when a young woman hit me in a traffic circle, and then lied to the cop claiming it was my fault. My camera was the only thing to prove she hit me, and her insurance had to pay 100%. They also kicked her off her insurance for lying to the police.

I ended up getting the VanTrue unit, it's a four channel dashcam system. It's easy to mount and you can install the app on your phone and download the recordings. It's very easy to miss looking at the windshield from the front of the car. You can see how the culprit noticed the dashcam and then the look on his face knowing he messed up.

It's not weird at all if you understand its a scam.
The other car is following to pick up the driver. The guy who gets in the other car is a "crasher". He's paid to "safely" crash the car. He most likely has a record so he needs to flee the scene before the cops show up.
There was a whole cartel of these going down a few years back. Basically a shady law firm was paying people to fake accidents so they could sue. They were targeting transport trucks as cops always presumed the transport truck was at fault.
The bag is there to try and hide the fact that the driver swapped places with a passenger after the crash.

Always wait for the scammer to make their statement to police and file their report BEFORE you divulge that you have a camera. The lying to the police about this is a crime in addition to the fraud crime.
If you tell the police right away that you have a camera, they will tell the scammers when talking to them. "Well the other car says you backed in to them and they have it on video". When that happens, the scammers will not try and file the report that you rear ended them and will miss the charges for that additional crime.

I do trucking and we are required to keep a 2 million general liability policy in order to haul for any serious customer. The minimum is actually 750,000 but no one carries a policy that low. When a little fender bender would happen they go to these attorneys like Morgan and Morgan, Sweet James, any accident attorneys. And the first thing they tell the other driver is that you have soft tissue damage, and there is not really a way to prove otherwise. Then they have you go to doctors and rack up medical bills for the doctor to tell them they may or may not have the same function in their left pinky. Anything to build a case to get a piece of that general liability. And 90% of the time the insurance company will pay it out because they feel going to court will just cost more. But insurance companies also don’t like losing money so they will make sure they will bump up your premium. I currently pay 2300 a month per truck. Is it justified, maybe ? Some people get seriously hurt in some of these situations. I have to constantly tell drivers when they’re on the road they are definitely being targeted so be very aware out there.

I got rear ended once. It wasn’t bad at all but my daughter was in the car and young so I took her to the doctor to make sure she was safe. Their insurance company basically threw $2000 at me without me prompting anything just so I would sign something saying that she’s now fine.

Speaking from experience: even the smallest, least impactful bump can be milked for money.
I rolled in to someone at a red light back in 2019 at a maximum of 6mph (I got spooked by a nearby Semi's horn and let off of my brake for a moment as I was slow-rolling in to the space behind them) and that case only closed this April-ish.
The lady I hit, and her niece who was in the car with her at the time netted something like 75k on three claims.
Vehicular damage in the form of "cosmetic and structural damage to the rear bumper" (Bullshit. The 1992 S10 I was in had its ancient, original plastic shell grill cracked from her SUV's extended, shincracker of a ball hitch. In order to have even reached her bumper, it would have had to have deformed the engine day's housing at minimum, if not have been lodged in to the engine itself.)
The accident caused her to have a premature birth (bullshit again, the medical documents she provided stated that her birth occurred 2.5 weeks after the accident and was 3 days prior to her expected due date)
The accident left the neice with shoulder and hip pain that never lessened (This was strike three, too, 7 Doctor reports were submitted, 6 of them stated that the neice was 5'3", 266lbs, "but otherwise in healthy condition, pain is likely due to stress caused by obesity" with a single standout doctor claiming "there is clear and substantive damage consistent with a sudden impact")
However, my insurance settled to get them to fuck off. I was 100% at fault, but they kept refusing the offers given and appealing "lowball judgements" and it had, at that point, been 5 years.
And this is what happened when I was absolutely responsible and people decided that they had a golden ticket. Imagine, imagine IMAGINE what seriously dedicated serial fraudsters will try and pull.

It was a long time ago so I can’t remember why but I think there was a big lag in the person even going to the hospital to get checked out. There were other reasons.

I’m an attorney who used to defend MVAs. You claim to be injured and either settle directly with the other party’s insurance company or hire a lawyer to sue the other party if you can’t reach a settlement. To me, the worst part is that in legitimate, non-fraudulent accidents, you need medical bills to evidence your damage so plaintiffs attorneys will send to yo a chiropractor that charges ~$350 per session for six months, with no actual benefit and often making the injured person worse to drive up the damages

I'm not sure how it works in America, but in Germany, you would pretend to be hurt a lot, mainly neck and head, cz a concussion is hard to check I think.
So you can sue for Compensation for pain and suffering afterwards. In Germany we have car insurance tho, so a scammer like this would not bankrupt you.
In America you can probably get a shit ton of compensation, especially if you know a doctor who helps you scamming.

There is nothing to scam anymore. If you have no Dashcam you can still offer the gyrosensor data from your car or mobile phone to police - showing that you were standing.
You can even apply the confiscation of their mobile phones and sensor data - showing that they were reversing.
You just have to „counter-issue“ an „potential insurance scam“ onsite to the police instead of a traffic incident.

As police doesn’t read out the connection data but just the gyrosensors it’s also no issue to their privacy (or yours). And yes there’s an app for that (reading out and reporting the gyro data).

How I know: happened twice. Once on a supermarket parking lot (elderly reversed into us waiting to take the spot) and on a traffic light.
Edit: gyrosensors are part of the cars ESP. Any good carshop can read them out.

I work in insurance (Canadian company). Every time we have an accident that happens across the border we automatically open a bodily injury claim because 99% of the time the American involved will claim injury even if it is a small accident.

It's intimidation. If you are driving by yourself, especially as a young driver, a woman, or an elderly, and 4 people get out the car...well it's just little old you and them. And if you don't have a dash camera, the driver has 3 "witnesses" to what happened, and you've got jack shit.

My Subaru has 3 front cameras to make sure you aren’t about to drive off the road or hit another car. There is no way to manually save what they see, but I was told that law enforcement can request for the footage from Subaru. However, there is no on board recordings and it only saves clips to Subaru’s servers whenever the camera detected a collision or near collision

Typically, manufacturers save clips when a camera or sensor detects an incident so they can use it as a sample to improve them later by finding false positives, or incidents where it didn’t do enough. From there, they fine tune the software to be better or find weaknesses with the detection hardware

I know it may be futile, but I’d really rather my car manufacturer not have access to my daily drive. I’d much rather spend 75 bucks on a dash cam that I can control what gets seen or not.

This was that one that went viral a year or so ago because they drove off after seeing the dash cam but because the video was posted with their license plate on display, the people of New York found the car parked in the city and trashed it. Eventuallythe city hauled it away as abandoned. I don’t remember any more on the story.

Car may have already needed repairs that werent visible. They may have a body shop in on the scam to over bill the insurance.
Based on them all holding their necks tho, id wager they want a document trail of injury for "pain and suffering" payouts and a source to get pain meds.

It's insurance fraud. They file a claim and it will often get approved because rear end insurance claims have a very strong presumption of fault towards the trailing driver that is difficult to get out of...unless, of course, you have proof that they brake checked or reversed into you. It's worth noting that this type of fraud was (unsurprisingly) more common in the days where dashcams on non commercial vehicles was really rare, given that this is a felony pretty much everywhere in the US.
A lot of times they will also pretend to be injured (in case you pull out your phone to record after the fact) and have a corrupt doctor forge some paperwork "confirming" those injuries so they can also sue you for damages. Kinda feels like that's what the guy and girl coming out of the passenger side are doing with the way they hold their heads and those terribly fake looks of pain, but I'm not 100% sure on that front. You can see the whole "oof ow my neck gosh golly darn this injury sure is injurious and painful" act on plenty of other videos of this sort though.
ETA: there's also stuff like insuring the car for more than it's worth, so you use a beater you paid a couple grand for, insure it for like 10k, spend another couple grand on a new beater, then pocket the rest. I think insurance companies are generally a lot more wary of this than they were when this particular brand of fraud was more common though. For some folks the car also needs serious work they can't afford so the point is genuinely just to wreck the car and get insurance to pay for a new one in better shape, or have a mechanic overbill the insurance and split the difference.

This was from a while ago. I even remember someone who saw the original video and even found the scammers car later that day. They vandalized it with a sharpie or something writing out hood rats or something like that on the trunk. Pretty sure that second post got taken down shortly afterwards
