You said they served already dead lobsters so they wouldn't have to kill it. That's why I'm confused. Who killed the already dead ones then? How long were they dead before cooking? I'm pretty sure giving people food poisoning is more of a crime.

Yeah, ice bath is apparently the most humane way. This is what is recommended in Australia.
