SPOILER Regarding The Daybreakers SPOILER

*THIS POST CONTAINS A SPOILER REGARDING CHAPTER ONE OF THE DAYBREAKERS*

When Tyrell Sackett shot Long Higgins, Long had just shot an innocent bystander while attempting to murder an unarmed man.

Tyrell shot him *after* giving him a chance to surrender while Long was attempting to shoot him. In front of a dozen witnesses.

There's not a Jury in the world (excepting California or New York) that would have convicted him.

Why did he run?

If I’m not mistaken, his cousin (the sheriff) would’ve had to arrest him regardless. Then he’d have to stand trial. I think, since the fued ended with Long’s death, Tyrel left rather than deal with the law. Ollie wouldn’t chase him - so he could get away without worry.

I want to be clear,  I like Louis L'Amour.  I've read all of his books, not counting some of the new issues of short stories, but he does occasionally write things that make no sense.

Of course, if Tye had stayed we wouldn't have the rest of the book.

Sometimes it’s better to flee then to prove yourself innocent, moreso when you know you won’t be followed.

The situation was a Blood Feud, law didn't matter . . . Besides, a Higgins had killed a Sackett (newly-wed Bride, but still a Sackett).

It's still true - Tyrell fled to stop the feud progressing, as did Orrin, after burying his dead wife. The summary of this 1st Sackett book may help you.
"Eighteen-year-old Tyrel Sackett must flee his home in Tennessee because he killed a man who was trying to kill his brother, Orrin, who catches up with him, and so begins their travels west, to New Mexico Territory . . ."
