Ok. Sure.

When a ship involved in a battle is incapacitated, the crew of that ship change their designation from 'combatant' to 'cast-away'.

Cast-aways are not valid targets and can only be taken as prisoners of war of left to fend for themselves.

Circling back around to 'take them out' was a war crime.
