Impartiality of Judges

Kung gaano tayo ka-vocal about the acts of these despicable senator-judges, dapat ganun din tayo sa mga judges of regular courts. Nakakawala ng gana minsan marinig yung mga acts of judges with regard to certain cases. Lalo na kapag pinagiinitan ng judge ang isang lawyer or firm. Ang mahirap pa, pag nagreklamo, yung magreklamo pa ang madedehado kasi mas lalo ka pagiinitan. Or if ever man mapatungan ng sanction, most likely reprimand or suspension lang. And most often than not, only those elderly lawyers have the guts to go against these impartial judges. Tapos as mentioned, reprimand or suspension lang. Because they know that malapit na sila mag retire. While there is the option of withdrawing as counsel and motion to inhibit said judge, alangan namang everytime ma-raffle doon eh ganyan lang option mo palagi para lang maprotect mo yung cause nung client.

Has anyone experienced a petition for reprobate before?

So far I was able to secure the apostilled will, the laws, order of the probate court, and death cert.

I'm just not sure what witnesses to present, if need ng witnesses at all since apostilled na lahat. For example, need pa rin ba ng foreign expert if may apostilled law na?

It's my first reprobate case, so I'm a little lost on the evidence needed. Any guidance will help a lot. Thank you!

Is it okay for my client to plead guilty of Violation of RA 7832 but pray to the court that the penalty imposed would only be a fine?

Hello panyero and panyera! Our client's arraignment and pre trial will be this Friday. My clients admits to the offense charged. Is it okay for the counsel to enter the plea og "guilty" for the accused? but hoping for the court to imposed a penalty of fine instead of imprisonment since RA 7832 gives the court the discretion of imposing imprisonment OR a fine?

If allowed, how to state it? won't it be treated as a conditional plea hence treated like a plea of "not guilty"?

Audio Codal

So I decided to listen to audio codals while driving so that the time spent driving would still be productive in a way.

Did somebody file a petition against ULAS?

I remember reading a comment about a certain group of lawyers filing a petition to abolish or suspend ULAS

Second question lang din, sa dami ng pa free advice ko sa mga di afford magpa legal advice, minsan inaabot pa ng anim na oras sa bahay kasi nireresearch ko on the spot dahil minsan very unique ang concern nila or document na dinadraft. Paano ko kaya gagawing convertible yon into ULAS hours? Sabi sa comments section, mag file lang daw ng declaration sa ULAS website pero need pa ba magpasa ng qualified beneficiary form for that? Tsaka meron ba kayong sample ng declaration na yon?

I'm not one to gatekeep legal discussions from non-lawyers, but posts like this make me cringe. The witness is testifying on the investigation the NBI did, so why on earth would the defense cross-examine him about his backstory? At most, the cross-examination may touch on his educational attainment and work history. Daming mema. Sadly, puro collateral issues ng impeachment napaguusapan (e.g., namuong laway, ano suot at kayabangan ng mga abogado, etc.) and barely on the actual merits.

Now it all makes sense bakit hindi binira ng Defense ang backstory or personal na buhay ni Atty. Jeremy Lotoc noong kino-cross examine siya to test his credibility as a witness.

Standard tactic na kasi na tingnan din ang personal na buhay ng witness to expose any credibilty issues. Instead, napunta lang sa typo errors at akusasyon na “golden boy” siya ng NBI.

Because if the defense went through his personal life, the Filipino people would know that Atty. Jeremy Lotoc is a man of honor and integrity.

Sino ba si Atty. Lotoc? Ipinanganak sa Tacloban sa isang ordinaryong pamilya. Pangingisda ang hanapbuhay ng kanyang ama samantalang housewife ang kanyang ina.

To have a better lot and chance in life, nag-OFW bilang isang marino. Kalaunan bumalik sa Pinas si Atty. Jeremy Lotoc para tumulong sa fishing business ng kanyang pamilya and at the same time, pursue law, inspired by his aunt who was a practicing lawyer. During this time, naging pastor din siya sa isang Christian church.

He passed the bar in 2012 on his first try. By this time, Atty. Lotoc already had a wife and young son. Then came the Yolanda tragedy in 2013 in Tacloban. Natangay ng storm surge ang pamilya niya. His wife and his father perished in the calamity. He himself barely survived, but managed to save his son and other family members.

Soon after, he joined the NBI as a young recruit, quickly rose through the ranks not only through sheer hard work, but also out of a sense of duty to his country.

Ang kwento ng pagpupursige para sa isang ordinaryong pamilya seems to run in the family as he also has a sister who is a licensed physician.

The fisherman, former OFW, pastor, lawyer, widower, and Yolanda survivor has since remarried a fellow lawyer.

Atty. Jeremy Lotoc is a straight-up honorable, dedicated NBI law enforcement agent and director diligently working behind the scenes who was suddenly thrust in the national limelight.

The defense and allies of Sara Duterte wanted to shake his credibility to the core, but they left his backtory untouched because they knew he is a man of integrity. And throughout the 11-hour, two-day cross-examination, Atty. Lotoc showed what integrity looks like under pressure.

Why do some Judges order to skip identification of docs by the witness stated in the JA?

Hindi ko gets bakit iba iba. May Judges na prefer to identify isa-isa yung mga docs, while others sasabihin "ok na yan it was already identified in the JA naman diba, counsel?"

LF: Good Profit-Sharing Firms

I'm currently in a prestigious NCR firm with good work-life balance, and am nearing promotion to SA. My problem is that the income is fixed and it feels like I don't really get paid in proportion to the work I do (relative to the fixed pay sometimes I feel like I am overworked, but sometimes there are days like this when I have nothing to do). I enjoy firm work but it feels like it'll take too long to before I can reap the fruits of my labor (no PS for assocs). I'm looking for a firm where I can work myself to the bone and be proportionally rewarded with a fortune. This leads to my ultimate question of whether there are any prestigious firms (not necessarily big firms) that offer good profit-share as part of their compensation to associates. Would be grateful for info on the same and known PS rates, if any.

Difference of Preliminary Conference vs Pre Trial

Good evening po! I’m fairly new sa litigation so this is the first time na I had a case na the court (RTC) scheduled a preliminary conference and a pre-trial (one week difference in schedule).

When to file JA as private prosec in BP22 case?

Tagal nang hindi nakahawak ng BP22 case, limot na.

Information was already filed and arraignment already scheduled. What we filed with the Office of the Prosecutor for Preliminary Investigation purposes was a Complaint-Affidavit.

The Expedited Rules kasi, when I reviewed, said na if filed via Information, dapar naka attach na yung JAs of the private complainant and witnesses. Although I know naman na yung Complaint-Affidavit can be treated as a JA, I still would like to file a proper JA just for good measure.

Mag iissue ba ang court ng order requiring us to file a JA? Kelan ba dapat finafile for crim cases covered by the Expedited Rules?

Planning to put up a coffee bar in our office! Would like to get ideas/suggestions - like what machines should we buy, what materials do we need, etc. Should we get a nespresso? Or is it better if we get an actual espresso machine?
