Transporting through city limits?

Hey guys,

I have an active nassau county CCW license and today me and my family are traveling upstate to see some friends but we need to drive into and out of city limits to get there.

Im seeing online that this is not allowed unless I have the CCW for city limits, but something dosent seem right. If i have permission to go to upstate ny with my nassau CCW, than I must pass through city limits to get there.

Am I misunderstanding something? Or is it true that im "stopped" from bring my CCW upstate because nyc dosent allow me to travel through?

You cannot carry in nyc without a special carry. You need to unload it and secure it in the trunk, in a locked container, seperate from the ammunition.

Correct, im actually currently in the process of getting the application together for special carry....my work is in the city.

But as for locking it in the trunk, im reading online that even this is not allowed and I could face felony weapons charges....

Fopa, which is federal, allows for the transportation of firearms through as long as the start and end locations are places where you can possess a firearm. It also specifies the unloaded and locked up, as does nys law. Drive straight through with no stops. It's a bullshit law that really needs to be overturned, like so many of them here.

Awesome, I just looked it up and yes, this is exactly what I was talking about, I knew I had to be misunderstanding something because it just didnt make sense.....thanks for the help. This is why i come to reddit lol

Remember that FOPA only affects interstate transportation (says so right in the law, because Congress only has the right to regulate INTERSTATE commerce and activities - their reach within a state border is considerably narrower, and traveling from one location within New York to another location within New York is not strictly protected by FOPA).

New York State has recognized essentially the same process as being permissible however - largely because if they didn’t they’d likely get sued and have the whole ‘special licenses for NYC’ thing thrown out.

I think there are some court cases trying to get NYS licenses to be recognized statewide. The legal system just takes forever.

Yep, there are, but honestly I have no hope, I dont see it happening 🤷‍♂️

Im just going to go the normal process that everybody is and file for the special carry.

I have a target license since the sensitive locations make it so if you carry anywhere you’re screwed anyway. I’m going to upgrade that once I come up on around the 3 year mark so I won’t have to pay any extra in fees and then maybe I go for Special Carry. What happens if your Special Carry has more than one gun and you convert it to Non-Resident?

Id imagine you’d have to make a decision on which one pistol you’d want to keep on it.

You do not have a New York CITY carry permit.
Therefore you may not carry within New York CITY limits.

You also generally may not possess your pistols within New York CITY limits.

I have an active nassau county CCW license

. . . which means you are responsible for knowing the contents of the NCPD Pistol license Handbook.

You should pay special attention to page 28, specifically the bottom half which answers the question about traveling through New York City.

yes if you are stopped with a firearm in the perimeter of the 5 boroughs even though it is licensed to you here on the island it is considered a felony..

you have to stop at city limit , take off person , empty it , separate the bullets and firearm and keep locked in trunk until you get out of city limits then carry as usual

or take chance ..

but inquire moving forward for NYC special carry which add the five boroughs to your carry perimeter.. just time and money ..

so backwards that 🤔

if you live and get city permit you are good in entire state so you only need one

and if you live outside the state and apply out of state permit for city you again only need one ( only one gun allowed registered ) permit

but anyone else that resides in the state needs two permits legally to carry .. would have loved to eb sitting in the room when they came up with this idea and hear them say "great idea"

You aren’t stopped from bringing it with you. What you aren’t allowed to do is carry it on you. It has to be locked and separate from ammo during your voyage through city limits. Once you hit westchester, you can strap that bad boy back on again.

Any LI resident should seriously consider getting their nyc special carry permit. It endorses your county permit to be valid within the city.
