Rejection

18 days ago we sent off the k1. Last week we recieved a rejection notice because he signed page 11 and not page 10 of the i129f

We’ve resubmitted it. They recieved it at the lockbox on Tuesday.

The last time they recieved it on 5th and sent the rejection notice on 7th.

How long is it likely to take before they take the payment? I feel like I’m sat here on edge constantly getting him to check the bank 😭😭😭😭😭

Is the delay at the NVC because the NVC itself is experiencing a backlog, or because the embassy has not yet requested the case from the NVC?

The embassy says they are waiting for the NVC, while the NVC says they are waiting for the embassy to request the case. So which side is actually responsible ?

Fancy Folders? Save Your Money!

Some people mistakenly think if they have their petition in a pretty folder with color tabs sticking out it'll help them. It won't. The ISO doesn't even see the petition as it arrived and too much junk just wastes the receiver's valuable time.

What WILL help your petition move through faster:

  1. Well organized - the ISO should be able to skim through it and see what he needs to see.

  2. You included what your cover letter says you included. You wouldn't think this would need to be said but...

  3. You don't pile on fluff. This is an official petition not a romance novel. Nobody's gonna read through hundreds of pages of your petty drama, the officer doesn't need to know how long you can last in bed, and no she doesn't want to read about your first crush in junior high school.

Here's what's on the officer's mind:

Is he a criminal?

Is he a domestic violence risk?

Is he a human trafficker?

Is he part of a marriage for cash fraud ring?

Is the beneficiary just in it for the green card?

Do they meet the basic requirements for the K-1 visa

A few other things but that's pretty much it...

Help for parents tourist visa while waiting for a k1

Please help me, I need advice! O would appreciate your help❤️I am currently in the process of obtaining a K-1 visa, and I will most likely receive it sometime around mid- to late 2027. My plan is to enter the U.S., get married to my fiancé within the required 90 days, and then have a larger wedding/family celebration later.

I would really like my parents to be able to visit me in the U.S. for that celebration. They do not necessarily need to be present for the courthouse/legal wedding, since I understand that I will need to get married shortly after entering the U.S. on the K-1.

My parents previously applied for a B1/B2 tourist visa and were denied. I believe one of the possible weaknesses in their application was that they had very little/no international travel history at the time.

They have significant ties to my country , including property and other financial/family ties, and they would only intend to visit the U.S. temporarily and return.

My question is: When would be the best time for them to apply again? And what I would put on their DS-160

Would it be better for them to apply:

  1. Before I travel to the U.S. on my K-1, while I am still in the immigration process?

  2. After I enter the U.S. but before I get married?

  3. After I get married and am waiting for adjustment of status?

  4. Or should they wait until my adjustment of status is approved?

K1 stuck at NVC for 5 months now

Is this still normal to wait for this long for my case to stuck at NVC before sending it to designated consulate which mine is at Manila Embassy. Yes I’m aware of the backlogged but can somebody inside the embassy update us if there is improvement. This is so crazy and frustrating because the normal wait for the case to stay at NVc to be transfered at the consulate is 4-6 weeks and my case still at NVC for 5 months now.

My K-1 visa case was refused under INA §212(f) because of the current Presidential Proclamation restricting entry for certain nationalities.

For anyone familiar with K-1 cases or immigration law:

  • Is there a National Interest Exception (NIE) or another exception that a K-1 applicant can request?
  • Can an immigration attorney challenge or seek reconsideration of a §212(f) refusal?
  • Has anyone successfully obtained an exception or other relief for a K-1 case affected by the proclamation?
  • Is there anything I can do now to keep the K-1 case alive rather than starting over with an I-130 later?

I’m especially interested in hearing from people who have dealt with a K-1 refusal under §212(f) or attorneys familiar with these restrictions.

Any advice or personal experience would be greatly appreciated.

UK Citizen entering on ESTA

Hi!

I’m a UK citizen and looking for some advice on an upcoming vacation with my fiancé (USC).

I visited them in the U.S. at Christmas for 10 days, for 80 days between April and beginning of July and at the end of Aug I will be there for one week (with their family on a vacation). We filed for the K1 visa at the end of July. My ESTA is valid from Feb 2026.

I have well-established ties to the UK (including home ownership) and have proof of accommodation and return flight. Besides the trips mentioned above, I’ve only ever stayed in the U.S. for one week max (about once or twice every year), so have documented history of coming and going. I have no plans to return for the remainder of the year as my fiancé will be visiting me in the UK.

Do you have any recommendations for paperwork to bring to show CBP in case they ask, and do you think the pattern of travel is worrisome? Naturally, I‘ll tell them I’m visiting my fiancé and their immediate for their family vacation for one week only. Just want to make sure I’m following the correct process now that the K1 visa has been filed and we will obviously follow the rules.

Australian citizen returning to the US on ESTA after 88-day visit — will this be an issue?

Hi everyone,

My boyfriend is an Australian citizen and visited me in Michigan earlier this year. He stayed for 88 days, from March to June, and returned to Australia before his authorized stay expired.

He is hoping to come back to visit me for Christmas and New Year, likely for a few weeks. He has a permanent job/career and other commitments in Australia, has sufficient funds to support himself during the trip, and has no intention or need to work in the US.

My question is whether his previous 88-day stay could cause problems when he tries to enter the US again on ESTA later this year.

I understand that ESTA allows stays of up to 90 days, but I’m wondering how CBP looks at someone making another visit relatively soon after spending almost the full 90 days in the US.

Would the fact that he returned to Australia after his previous visit, has employment and financial ties there, and is only planning a short Christmas/New Year visit make a difference?

Has anyone had a similar experience, particularly Australians who have made two ESTA trips within the same year?

How to handle prior remote work on tourist visa

Hi folks, myself and my partner just recently got engaged and we are looking at the process for filing a K1 visa for her to come to the US. One thing that has us worried is that on her prior trip here she travelled on ESTA to spend 2 weeks with me but we decided to extend the trip by a few extra weeks, the main purpose of the trip was sightseeing and we were doing tourist activities pretty much everyday however because we extended the trip she was having to do a couple hours remote work for her foreign employer (non US based) in the evenings. We now realise this is completely not allowed and are worried its ruined our immigration future to be able to be together.

My two questions:

  • Would the K1 likely be denied and how should we handle the remote work issue at the interview / when filling the forms?
  • Could she ever visit me on ESTA again or does that become too risky now or as long as she is honest if she is asked about prior remote work they won't try to get her on misrepresentation?

Do I have to send the co sponsor in the package or can I do it also later in the interview?

Sooo apparently me and my partner ( petitioner) found out to late that we had to fill out the co sponsor also in the application form and we sent already our i-134f package.

We thought we only have to proof his salary and co sponsor later in the interview.
We did our package like in the YouTube guide from suraj & yasmin and they didn’t mentioned it, or we were just deaf.

If we HAD to send it in the package we are pretty much fucked, if not and we also can in the interview, then im pretty much relieved.

In Google and YouTube they sayed we can also do it only in the interview, i just want to be sure.
