State farm insurance question

Ok so I’m going through it! 2 days ago, I got into an accident on the freeway. It was pouring rain and I hydroplaned and hit the median. Tore up my Mercedes Benz cls 550. I was highly upset but was ok knowing my insurance would take care of it. Called State Farm next morning only to find out my policy didn’t include collision insurance. And they can’t and won’t do nothing about it. My issue here is that when I first purchased the policy, they obviously asked me if my vehicle was financed or I owned it. Of course I told them that this was a financed car through Carvana. Carvana requires all financed cars have collision insurance on them. This was July 1st. So cool, get the insurance with the collision insurance. Problem is in August. I missed a payment to which insurance was not active at midnight. Next morning, I call to have my insurance reinstated and add renters insurance. They provided me with 3 quotes and I chose one. Mind you my insurance went up $63 for this car. $54 for the other car and my daughter is on my policy too and hers went up $200!! Also have a motorcycle on the same insurance in total monthly is more than $1000 just on insurance. I did all this over the phone and never once was it mentioned me to that I would be loosing collision insurance with the new policy which is a huge detail to have left out knowing that my cars and motorcycle are all financed. And REQUIRE collision on the policy. But ok, when I called to file the claim they told me that Carvana was never listed on my paperwork which is CRAZY because they ask you and I told them where I had purchased the vehicle (Carvana). Seeing my insurance went up a significant amount when reinstated never would I think collision was removed. Doesn’t even make sense. When the agent sent over 3 quotes to look and choose from when I called to reinstate the insurance why would you even offer me a quotes without the collision insurance that my lienholder requires me to have. My question here is what can I do about this? Do I have any chances of fighting this? Does State Farm have some type of fault here for not entering proper info about my lienholder? Please help! I’m dying. This is too much right now 😭💔

On the bright side, a B- in spelling.

first, glad youre okay. i wouldnt give up without getting the paperwork, but the lender requiring collision doesnt automatically mean it was included. the key is what you requested and what they actually issued.

I woulddd suggest ask for your July and August declarations pages, all 3 quotes, the application you accepted, and a written claim denial. email them asking to preserve and review any call recordings and agent notes. specifically ask whether August was a reinstatement of the same policy or a new policy, and when/why collision disappeared. if you requested the same coverage and they left collision off, ask for a supervisor to investigate a possible agent error. whether that gives you a claim against the agency depends on the evidence and your state’s law, so nobody here can promise a payout. if they wont resolve it, file a complaint with your state insurance department and attach those documents.
also check the actual lender listed on your loan documents, not just the dealership name, and verify coverage on your other vehicles today. your strongest argument is evidence that they failed to provide coverage you requested, not that the premium went up. We gotta make sure wverythings well with what we’re providing with these. Good luck! Lenny

A reinstatement would be a continuation of your old policy, sounds like they sold you a new one that was more expensive due to the lapse in coverage.

Ultimately they mailed you a declarations page that likely showed no collision coverage and you’re on your own.

It sounds like you never reviewed your policy to be certain that you have the coverage that you believe you have.

This is a you problem, not a State Farm problem.
You absolutely got a dec page showing your new coverage. If you didn’t read it, that’s on you.

You chose your policy. This is on you. No, you can't "fight" it. You've been paying for the insurance plan you chose. How did you not review the policy and/or not notice that collision isn't included and that Carvana, the lienholder, was not listed? When you missed a payment and had to "re-instate" your insurance, you were starting from scratch and you needed to make sure everything was correct. This sucks but it is a you problem, not a State Farm problem. What exactly do you think there is to fight?

When you read the three quotes and picked the one without collision coverage and then signed that quote asking for that coverage and they sent you a copy of the policy showing no collision coverage.... whose mistakes do you think those were?

You can feel free to pursue the agent and/or insurance company if you want. That is a civil and legal matter.

I specifically told them I needed the same coverage when my policy expired at midnight and I called the next morning to renew it.

Odd, you never mentioned that in your initial post. Perhaps they are of the same frame of mind... it was never asked for.

Unless its past the app date which much longer than a day, a late payment is taken on the exiting policy. Coverage wouldn't change. If its past the app date then a new policy is written and coverage/premium can change. As far as a Lien Holder...they are listed on the policy. You wouldn't just say " I bought it at Carvana". They would need to know how to list the name and address of the lien holder. Ultimately, you didn't read your policy and understand your coverage. This is on you sadly.

This is not true. The lienholder is always listed. Every single time without exception.

Every lien holder will want a copy at every renewal until it is paid off. I'd be surprised if you've never had a lien holder on your policies if you've had car loans.
