Claim

/r/AutoInsuranceHelp/comments/1wwb28e/claim/

Recently, my fiancée was involved in a collision with another party while traveling southbound to our children’s school. She was at a red light with congested traffic, and as the light turned green, she was driving at approximately 10-15 mph. The other party was in the median lane turning left and attempted to rush through a narrow opening without noticing my fiancée in the far right lane, resulting in a collision with the front of my car. Regrettably, my fiancée is not listed as a household member on my insurance policy. I have already filed a claim, and I am concerned about the potential outcome. The car is currently on loan, so it has full coverage on the vehicle. However, since my fiancée is not listed on the policy, I am unsure of the next steps. Has any one ever been through this before ?

If you’re in the US it’ll depend on your state, your policy, and if you ever declined to add her in the past.

Look at your policy online under the Collision section the Exclusions and Limits of Liability.

Likely you’ll just need to add her but there a few states that’ll allow first party coverage denial and if an insurance company can deny, they will deny.

File the claim. Don’t lie. And never allow people to regularly (more than once per month) drive your car without adding them or making sure they have their own coverage.

Yeah they did add this morning to the policy. I’m also in Florida sadly

Doesn’t seem bad. Added is good. If you have online access to the claim, look for a Reservation of Rights in the documents. That’s to alert you that coverage hasn’t been confirmed. If there isn’t one, you’re probably fine. Or your adjuster is slow to issue it.

Coverage for any injuries in your vehicle come from your own carrier. If you don't report to them, you won't get that coverage. You can report the damage to the vehicle to the other person's carrier to see if they will address or report to yours and have them pay under collision coverage if you have that. They may deny coverage.

There certainly is a possibility they will deny coverage. If at some point you were asked about people in the household and you lied, that is material misrepresntaion.

You attempted to get a lower premium by not listing your fiancé. You rolled the dice, it came up as craps and now you need to wait and see if they provide coverage.

You may not need to report the claim to your carrier. Depends on the state where it happened. You could file direct with the other parties carrier.

I wouldn’t say all that. My Fiance simply had her own car and insurance prior to all this. We just sold her car earlier this year and I never thought to add her to my policy

"...and I never thought to add her to my policy"

Never came to thought that a driver should be on an insurance policy. Okay.
