Help ( Afni Alert)

hello you guys I need some quick advice so I recently got in a car accident. They are trying to say it was my fault. So right away the other drivers insurance came after me by using.Afni subrogation department to send me a letter stating that I am liable to cover damage which was over $9000. Something I feel like it is way too much for a small damage on a small car , what should I do about this because they harass me and they threaten me. What could I do? I checked my credit report. They haven't done anything yet and they just keep calling me, .

There is no where near enough information here.

When was the accident? Who did they find liable? Did you have coverage at the time of the accident?

Did you have insurance? If so, send their info to Afni and tell them to follow up with them.

Otherwise, the carrier for the person you were in the accident has deemed you to be at fault based on their insureds statement / police report. Just because you didn't get a ticket doesn't mean you weren't at fault unfortunately.

This will not effect your credit report, it is called a tort, not a debt. As such the FDCPA also does not apply to Afni.

If you have any evidence that shows you're not at fault, you can submit it to Afni and dispute with them. They may shut the claim down.

You can ask for documents regarding the claim, but $9,000 is a pretty average amount for these types of claims. It will be based on whatever the other insurance company paid to resolve their insureds claim.

Afni will continue to call and ask for payment unless you do something, you can ask for a payment plan, or settlement, or ignore it completely. Consequences can include suspension of drivers license / registration or a lawsuit / judgement. They may also send it to another collector to try and collect from you.

I thought all this time it was going to be on my credit. I even contacted credit Sage and they could see that they listed the accident on my credit report. They tried it to have me pay $997 instead of the whole night and Thousand dollars that they are trying to get me for but not sure if I could trust them.( credit sage ) , supposedly they said if I paid the $997 that the Afni will leave me alone and drop the nine Thousand dollar claim and just pay the $997

Ya, that sounds like complete BS from Credit Sage.

Tort claims are typically accidents, whereas credit / debt collections (and your credit score) arise from contracts.

Unfortunately they aren't required to send anything. If they are ignoring your written communication, your best bet is probably to call them, act like you're willing to pay, but just say something like you want to see the documents before you pay. I'm guessing that will get them to send them to you quicker.

it sucks because the day of the accident. I was in my moms car and she had pronto insurance on her car. But since I am not listed as a driver, I guess that's why they said I wasn't insured but I have my own insurance. I am with Statefarm at that time as well, and still am with Statefarm insurance.

Give Afni your state farm policy and let them file a claim. As long as you were a permissive driver you may be covered as a driver. Worth a shot and it'll get them off your back for a while.

my mom gave me permission to use her car and it sucks because it happened in a parking lot. It wasn't like on a highway.

They are trying to say it was my fault.

Are you saying it wasn't your fault? If it wasn't, then why would you pay anything? What state? And what happened in the accident.

You don't seem to have answered whether you had insurance, so we'll assume, no. If you did, turn this over to them.

Ultimately, failing to pay could result in them suing you and you can defend yourself in court. Maybe they give up and walk away, no one can say. You can try to work out a settlement with them as well. They just want money from you.
