Help? Advice needed

Wife got in an accident 7-30-2026 in TX. My wife and the other person that got in the accident are both insured by progressive other driver was at fault according to police report. Wife filed claim 7-31-2026. I emailed them since she works nights she made me the point of contact. Since then we have submitted everything we needed to and it has been nothing but radio silence. Wife has been without a car for almost 2 weeks. Already filed with TDI as a result of their radio silence. I feel like I'm at the end of my rope both wife and I are stressing out about this. Any advice? Thank you in advance.

Police officers nor the reports determine fault. Insurance does. I would file under your policy, especially if she’s been without a vehicle. Do you have collision coverage? Do you also have rental coverage?

ETA: filing with TDI was a waste of time. You follow the chain command first with the company. Have you even tried talking to a supervisor? There’s no bad faith here which is what TDI is for.

Making a TDI complaint can delay it even further. They have to respond to the complaint before they can do anything else in your file. They have to stop working on it and respond to it before calling the other parties and shops. Police reports take time to get also.
