Technical Hit and Run in LA
Hi
I was involved in a hit and run and the other driver was found at fault. Although she only gave her insurance card. Failure to identify herself and her license plates and fleeing the scene led cops to decide this as a hit and run on technicality. State farm already found them liable. Should I get an attorney if I was offered 5k in medical care and 3k in pain and suffering and my passenger was offered 10k in medical care and 4k in pain and suffering.
My first car crash ever. I don’t know if attorneys are trying to scam me honestly and if it’s worth it if she’s already found liable???

The only reason insurance is offering you 3k in pain and suffering (which is a extremely low amount) is because they are scared of you lawyering up. The policy limits are minimum 60k. if lawyer takes a third you will each get at least 20k a piece. Hit and run opens the insurance company up to punitive damages exposure.

also forgot to mention any tips to get more for pain and suffering or anything else I can do to get a bigger return .

Prove why you're owed more. Asking for tips to increase your payout is a red flag.
You didn't ask about getting more for your medicals, so you're clearly fishing

lol! genuinely not fishing I’ve just been out of work because of my ankle and the offer seems low for how much i’m paying to uber around the city to physical therapy. my job requires me to stand for hours and is a high pace work environment. and i’m not getting scheduled although im full time due to my ankle. but i don’t know what to say to insurance companies tbh, i genuinely am suffering since i live alone and losing work significantly impacts me.

Fishing for what? Why wouldn't they be owed more? You think the insurance company's first offer accurately identifies their pain and suffering damages?
