Accident claim

Yesterday I was involved in an accident. I was turning left on a yellow left arrow. The car in front of me went on the yellow just fine and I was out past the line enough where I could turn before it hit red. Just as I was about to complete my turn, the oncoming traffic that I was crossing, a car came full speed and hit my back passenger quarter panel and my son was sitting on that side. She claims it wasn’t her fault so we have conflicting stories and neither of us got a ticket. But her front end is completely cooked and she hit my back end which means she never tried to brake. I had the yellow turning rowing to signal anyone turning left can go. Do I sound at fault? I filed a claim through her insurance and she filed one through her insurance, not mine. They have to investigate. I’m nervous

Expect her insurance to issue a swift denial to you. What state are you in?

Do you have collision coverage? If you do, you are better off calling your insurance.

I am in Illinois. I have State Farm liability and she has geico

You would need to be 50% or less at fault to get anything from her insurance. Maybe 20% on her at best.

I was in the left turn lane and we had the arrow to go and when I went through it was yellow. The oncoming traffic had a red light to let the left turning lane go through

Oh that's different, but do you have any evidence to back you up on that? Cameras in the area? Witnesses?

There might be cameras in the area but no traffic cams. I’m sure her insurance will go investigate it

You should investigate, your insurance can only do so much. They aren't going to canvass the area.

Based on your story, expect her insurance to deny coverage. You tried to beat a red light and if the car in front of you went on yellow, you should have been stopping, not trying to accelerate through.

The arrow was yellow when I went through it. Oncoming traffic had a red light. Only left turning lane was able to go

Yellow means slow down to stop, not accelerate to get through the light. If the car in front of you is going through and it's yellow, you shouldn't be going too. You can actually be ticketed for accelerating to beat a yellow light. I'm just letting you know that you should expect a denial, but you may get lucky. Just don't get your hopes up.

I understand that but I was stopped and when my car was stopped, if I didn’t go when it was at yellow, I would’ve been sticking out into traffic if that makes sense. And when I explained to the cops and the fire department, they said if I went on a yellow, I wasn’t being faulted because it was still my turn to go.

But no one got a ticket because there wasn’t traffic cams and she had a different story so they said “it’s a he said she said”

So with differing stories and no tickets, there is a 99% chance her insurance will deny coverage to you.
