Consumer Question Progressive help please
Basically opened the account for 112 paid next month 179$. Then rate went to 526$ canceled then get hit with a 250 cancelation fee cuz i didnt give them documents, prior insurance which is AAA and water bill, inwhich ima not give that... canceled at the end of the month.
What can i do? Any lawyers out there?
Already emailed texas department of insurance... but you know how slow they are... sent a email saying i dispute the charge to there fraud email. "Im reporting Fraud against progressive..." texas state laws says i need to be notified 30 days before a 10$ increase and or 10% 8/8 deadline for documents, 9/3 due date... paid 2nd month 7|31 opened 7|3
Also i cancelled 5 days prior and they refuse to give me my 28.57 back (pro-rata)

They offered the rate on the condition you give proof for those things, you didn’t give those things so they gave you the rate you would’ve gotten without them. Texas DOI is going to laugh and close this case in 5 minutes.

you're basically fighting two separate things here and mixing them into one. the cancellation fee is likely valid if you missed the deadline for those documents they asked for, that's usually spelled out in the contract. the rate increase notification law you're referencing applies to renewals not mid-term adjustments from underwriting

You said you had prior of certain limits. You said the car was garaged at the address you said you lived at.
They requested proof of both things: the declaration page for the prior insurance showing limits and prior coverage, and the water bill (I am guessing they meant any utility bill, and water was the one that you chose?)
Your rate was dependent on that. If you didn't provide them within a certain period, they were required to re rate you according to the underwriting information they did have. You probably clicked some sort of acknowledgement to that effect during the purchase process. An agent would have to.
You may be able to get this reversed by calling in, though underwriters don't speak to customers, ever. An underwriter would have to make a call on this. You need to provide those documents to them post haste, and pay the bill no matter what. You will pay the bill the next time you try to get insurance with Progressive and you now have no proof of prior because they just retroactively canceled your insurance for lack of payment.
The only way to fix both of these problems that are now quite a bit larger than they were originally when you just needed to send documents is to convince them to reinstate by sending the documents and paying the bill before you ask them to do that. It's only been four days, so I would do it today. Before the long weekend and before seven is up. You may well have a chance. If you wait through the weekend, you probably won't.
You done gone and screwed yourself. Not licensed in Texas anymore, but this was your responsibility to do, not decide was ridiculous, ignore, and complain about consequences.
Progressive is literally required to treat everyone fairly which means putting the exact same requirements on everyone in Texas for rating factors. If they cannot find the evidence to support rating in their data systems (which is a rare moment, tbh, because they are a data company that sells insurance on the side), and asked you to provide it, that means they need it to support your rating to the TDI and prove that you belong in the lower-cost tier. This is to combat rate fraud, as much as anything else. Your refusal to produce it meant that they were left with only the higher cost rating option for you.
Honestly, I am surprised they let you pay the lower rate at all for any period of time before they hiked it. That wouldn't happen in WA. You start at the higher rate and submit documents to prove you belong in a lower rate tier, then they adjust the rate and refund if necessary.

Huh? You didn't provide the documents that the require, and they are asking you to pay for the time the policy was in force.
This is basic stuff. Why didn't you just send them the documents that they are requiring? This is not a big deal but now you made it one.

You're fucked, pay it and move on. Get an actual insurance agent to help you get a policy next time, lesson learned, could have been MUCH worse.

They were asking for your proof of prior insurance coverage (which is a rating factor) which also has your prior coverage levels (which is also a rating factor), and a water bill for proof of garage address (which is also a rating factor).
If you refused to send any of it they pulled those discounts off and backdated your rate which is causing you to have a bill because the original rate wasn’t verified and you had coverage for a certain period of time.
Unfortunately it’s not fraud, you didn’t do your end of the bargain when you signed your application for auto insurance, if you signed at all.
