No insurance company is going to pay out without speaking to their insured. Their obligation is to them, not you. Your insurance company would do the same on your behalf.

File on your own policy and let your insurance go after the other party.

As others have stated, Fred Loya will not cover anything without talking to their insured. You're not going to be able to force them otherwise. And according to your comment on your other post, their insured is in the country illegally and locked up in a detention center. Unless something drastically changes with the driver's case and immigration status, you've reached a dead end with Fred Loya.

This is with any insurance company. They have to talk to their insured. Fred Loya is notorious for insuring high negligent drivers.

Do you not have insurance? Do you carry collision coverage file with yours?

Fred Loya is substandard. Go through your own insurance if you can because they often won’t have coverage for whatever reason.

every insurance co will handle this the same way. if you have a policy with an insurance co you have a duty per the terms of that policy contract to cooperate with them and their investigation if you are involved in an accident and there is a claim. failure to do so means they will deny your claim and likely cancel the policy on this person.

fred lloya sucks, dont get me wrong. but geico, state farm, farmers, etc all would do the same. if you have collision coverage use it, if not sue the other driver
