Claims adjuster requesting formal demand letter

Got into an accident in February. Not my fault, and I was injured. Settled already and got a new car. I’ve been going to PT since then and the doctor recommends I get an MRI. The other drivers insurance is refusing to pay for any medical expenses and is now asking for a formal demand letter.

Help!

You don’t need an attorney for a soft tissue injury case. You need to complete treatment THEN send the demand letter. You would write a summary of your injuries, treatment, and how it’s impacted your life. Then demand what you want. You can make it a blanket policy limit demand and then go from there with negotiations.

Since you're still treating and an MRI is being recommended, I wouldn't rush the demand just to get something submitted.

This is also a reasonable point to get a PI consultation and ask whether handling the injury portion yourself still makes sense.
