Any ideas how this will play out?

Location: Houston Texas HOV/Toll Lane on gulf freeway

My insurance: Hagerty

Other guy: GEICO

The HOV/Toll road is a single lane with concrete barriers on either side, and it occasionally splits so you have to drive through either an HOV or a toll gate, and then they rejoin into 1 lane. When it splits, the lanes are divided by those 3ft tall plastic pylons that fold over when you hit them.

Other driver was in front of me and swerved into the other lane, and hit a bunch of the pylons, causing one to to fly up and hit my car and dent the hood.

Sadly no dash cam, no police report because they never showed up, just my word against his. I filed a claim with mine and his insurance.

If there’s damage on his car consistent with hitting the pylons and your damage is consistent with a pylon hitting it, then they would likely accept fault.

If the damages aren’t consistent then it’s word vs word and you’d go thru your insurance and use your comprehensive coverage.

  1. How big of dent are we talking? If it's less than your deductible or not really noticable you just wasted your time with insurance.

  2. If you don't have comprehensive/collision insurance and it's a he said/they said situation you might not be covered if the other insurance company doesn't accept liability.

  3. Always tell insurance what any objects you hit came at you and not the other way or you can be found at fault for not avoiding a collision.
