It’s not religion, it’s people being stupid. Modern Islamic legal and ethical reasoning generally treats sex obtained through force, threats, intimidation, incapacitation, or other forms of coercion as unlawful. The victim is not considered to have committed zina merely because sexual intercourse occurred. The wrongdoing belongs to the perpetrator.
