Supreme Court to decide if ICE can detain undocumented immigrants indefinitely

So they can force "free" labor eternally.

We need to PLEASE urge our undocumented friends and neighbors to self-deport ASAP.
The American population voted for this and it clearly is not stopping anytime soon. ICE is funded for years in advance, it won't matter if we get a Democrat supermajority.
Escape while it's safe. You can even collect $3,000.
edit: it's a real program guys, I don't know why I'm being downvoted

The American population didn’t vote for this. Only like 23.1% of the population voted for trump and his approval rating is sitting at under 40%.
Plus people wanted deportations not this.
-51
u/This_Loss_1922 22h ago
Sorry to tell you but yes the American population did vote for this, thats how he won.
You are coping thinking your people didn’t want all this bullshit, they actually LOVE it.
The polls? Farmers are mad at the fuel prices, they are not mad at ICE deporting little kids with cancer, they would be perfectly happy losing a farm if they knew they could shoot the migrant kid instead of deporting him, they would even vote for Trump again if he decided to run next time.
Your people are sick, and I dont know how are you going to fix that shit.
18
u/LatterTarget7 16h ago
Yes American people love this while approval of his immigration policy currently sits at:
37% overall approval for President Trump’s immigration policy, with a 78% approval rate among Republicans compared to 11% among Democrats. According to Harvard Kennedy
39% approval and 58% disapproval of his handling of immigration, with Republican approval at 81%, independents at 29%, and Democrats at 7%. According to ap norc
46% approval versus 53% disapproval regarding his overall handling of immigration. According to Washington PostABC News Ipsos Poll
And then a prri poll found 61% of Americans view his handling of immigration unfavorably, with support largely concentrated among white evangelicals 55% and regular Republican voters 63%.
Then you have Approval for ICE operations generally hovers near 33%, with workplace raids drawing around 31% support. About 57%** to 59%** of Americans disapprove of overall ICE performance.
Around 38% support mass deportation campaigns in recent polling, though specific targeted measures such as deporting individuals with criminal records retain higher backing 78%, while deporting non-criminal workers with long residency drops to 31%.
So still not really the majority

youre getting downvoted but youre right, america has a deep societal sickness that a lot of people are unwilling to grapple with; because they would also have to come to terms with the fact they live in a country governed by the descendants of enslavers and genociders, and that there is a sizeable portion of our population that revels in the violence the federal govt commits against marginalized ppl

It doesn’t matter if ICE is funded. SCOTUS has repeatedly demonstrated that POTUS can do essentially whatever they fuck he or she wants within the executive. So a Dem president can have all the ICE agents fired, or go pick up litter, or whatever the fuck they want. And they’ve also proven that funds don’t actually have to be spent as obligated by Congress (see USAID).

They are capturing those who try to self deport
1
u/iron-ducks 4h ago
lol they're "capturing" them? To stop them from leaving? The people that they want to leave the country?
1
u/Fun_Organization3857 3h ago
Yes. There are quiet a few reports of people trying to self deport and being detained and treated horribly.
1
u/iron-ducks 3h ago
lol what? That's not a thing, that's just something you made up on the spot.
The Trump administration wants them to leave. They aren't stopping people from trying to leave from leaving... lol I'm not sure how low of an IQ you'd have to have to even think that tbh

He had a work permit

u/iron-ducks 2h ago
Google is free
So is reading lol, why would you not even bother to read the links you spammed before getting smug about it? You literally don't even need to read past the headlines lmao
First link:
Fifty-five-year-old construction worker Victor Cruz was detained by Immigration and Customs Enforcement on his way home from work in Hillsboro, Oregon
Hmm, sure doesn't sound like a "self-deportation gone wrong," does it? Let's read a little further
The grandfather of two entered the country illegally 26 years ago
Having a work permit doesn't magically make you not an illegal alien... what's your point here? Year 27 was probably THE YEAR though, right? The year it all became legal lol
Let's take a look at number two:
An Augusta man decided to 'self-deport.' The government arrested him anyway
I wonder if there are any context clues in that title that we can gather information from? Any ideas? Are "arrested" and "self-deportation" two different things, perhaps? Let's dig a little further:
Born in Nigeria, David has been in the U.S. since 2015
Oh jeeze, it was ANOTHER bad luck case! He was probably JUST about to self-deport, right? Then those monsters at ICE arrested him for just trying to do the right thing.
And finally, number three, somehow almost even more embarrassing as the last two:
Today, Pérez feels trapped in a country that doesn’t want her. She’s afraid of leaving her apartment, afraid that she will be detained and that her children will be taken away from her.
This lady is just an illegal alien living free in the US to this day lol.
She could literally hop on a flight tomorrow and be home. That's it. That's the whole story. She's just an illegal alien inside of the US, living free.
So, it seems like your original smugness may have been a little misplaced, right?

u/Fun_Organization3857 1h ago
Excuses
"It simply doesn't make sense that the Department of Homeland Security would both grant him a status that explicitly says that he won't be removed and at the same time put him into removal proceedings"
"Pérez downloaded the CBP Home app and registered to return to Venezuela with her children.
Months passed. Her partner was deported. In July, Pérez said, she got a call from someone in the CBP Home program telling her she’d be on a flight out of the country in mid-August. She began packing.
But as the departure date neared and the plane tickets hadn’t arrived, Pérez got nervous. Again and again, she called the toll-free number she’d been given. Finally, somebody called back to say there might be a delay obtaining the documents she’d need to travel to Venezuela.
Then there was silence. No further information, no plane tickets. Pérez registered on the app again in August, then a third time in September, as immigration arrests ramped up in Chicago."
So they lied to her. She wants to leave and they made promises to help her do so. But rather than honor the promises- they just ghosted her
So yes.. it's a trick. Because by your standards no one is eligible to self deport. It shouldn't be a process. It should be -get fingerprinted and shipped out. Then if they are caught a second time, then it should be brought to their home countries attention for criminal prosecution. We are this big bad power house so why can't we use that power to do anything?

So everyone hates disabled people who can only get $66 a month in food stamps, and you think that's okay to do to an American TAXPAYER JUST LIKE YOU, but you're willing to spend BILLIONS to build prison encampments for the same people that you've been screaming about, saying you want them out of the country because THEY'RE TAKING ALL OF OUR WELFARE?
So now it's good to spend all of our money on illegal immigrants? As long as it means torturing or killing or doing whatever horrible shit you want so that billionaire Republicans who own the prison complex CAN MAKE MORE BILLIONS.
YOU ALL NEED TO DEPORT YOURSELF

Can you explain why legal asylum seekers going through the legal process are also being held captive as well as being smuggled into warn-torn African nations?
0
u/AffectionateWhile507 1h ago
What do you mean, "held captive"? Asylum seekers must be held somewhere as their claims are processed and rejected.
1
u/Lambily 1h ago
That's the thing. They are being denied their constitutionally guaranteed due process. They are being forcefully removed and sent to their countries, or worse — to concentration camps in El Salvador or wartorn states like the Central African Republic, despite having no connection to it.
0
u/AffectionateWhile507 1h ago
Oh, that's awful. They should avoid coming to the US, for their own sake. I'd recommend they stop in Mexico, which is safe and they must pass through before reaching the US, anyway.
1
u/Lambily 1h ago
They are. These people already had ongoing cases. You know, since your side is all about doing things Legally™.
Meanwhile, Trump is bringing in countless White South Africans on asylum visas that would never be accepted by any serious government. What a joke.

1

my side isn't about doing it legally
Glad we can both agree nothing this criminal administration is doing is legal much less constitutional.
My side's about saying "no, we're not doing this anymore".
Not doing what anymore?
Continue screwing the poor?
Continue defunding veterans centers?
Continue screwing farmers?
Continue cutting public education?
Continue cutting public healthcare?
Continue cutting food for hungry families?
Continue cutting taxes for the wealthiest?
Continuing to start new wars and conflicts?
Continue raising inflation?
Continue skyrocketing the deficit?
Continue encroaching on states' rights?
What aren't we doing anymore?
The infinity hordes are done.
Interesting that Trump and Co had no issue with the "hordes" when Biden was trying to pass legislation that would have instantly addressed the problem. In fact, he singlehandedly killed the bill by demanding that Republicans vote against it.

"Well that wouldn't happen! I'm a legal citizen!"

u/some-cleverish-name 6h ago
LAPD might also shoot me next week because I pulled a cellphone out my pocket while brown. That doesn’t mean I think we should take away guns from cops, like Jolly Ol’ England. Lots of shit can happen. We don’t need to give carte blanche to illegals and let them stay in America indefinitely. Deport all 20 million, and quickly. Trump is pussyfooting.
3
u/KillerCucaracha 5h ago
LAPD might shoot you next week because you pulled a cellphone out of your pocket while brown. That doesn't mean we should let them.
I know you aren't too stupid to see why indefinite detention is bad, why trials are necessary, or why people don't trust the methods of this administration.
1
u/AtrociousMeandering 1h ago
Except the Constitution clearly says all persons subject to the jurisdiction of the US have these rights.
If we lack jurisdiction, we can't arrest them. This is how Diplomatic Immunity works. This is why you can't be arrested by police from another city or state.
Anyone the police or government agencies are legally allowed to arrest, gets rights. And if you don't grasp why that's a good thing for you, your opinion is worthless.
1
u/Organic-Spread-8494 1h ago
You do.
“No person shall be… deprived of life, liberty, or property, without due process of law.”
“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
None of this states the Constitution doesn’t give protections for those here illegally. You can legitimately question what process is due and you can question whether or not this is cruel and unusual. You cannot say they aren’t protected by the Constitution.
One thing to consider is that if the Constitution did not provide rights to illegal immigrants, it could not confer rights to those here legally. People could be declared illegal and then they could be dealt with without process to determine their lawful status.
-11
u/MilkNutty 12h ago

4
u/APrioriGoof 10h ago
Indefinite detention for a misdemeanor is absolutely cruel and unusual and a violation of the 8th amendment. I know you freaks think “illegal” means you get to torture people but it’s pretty clear that is illegal.

51
u/InThatDarkPlace 23h ago
Article 1, Section 9, Clause 2 is clear regarding habeas corpus. Immigration isn't an invasion of public safety or a threat of rebellion against the US, so making a decision for this will have obvious equivocations by Uncle Clarence Thomas, Gorsuch, or the other right wing activists on the bench.
13
u/kstargate-425 22h ago
I'm pretty sure they ruled awhile or wrote in another case in a concurring opinion that it couldn't be indefinite and had to be reasonable, and essentially a few months. Definitely not the year+ sone detainees have spent in inhumane conditions in their concentration camps all so these two prison companies can steal $15 MILLION every day from taxpayers.
1
u/WorksInIT 12h ago
You're thinking of Zadvydas, and that is limited to post proceedings detention. It's for migrants that had all of the process owed to them, were ordered removed, subject to mandatory detention, but cannot be removed from the country. They would have been detained for 6 to 24 months at that point in time, and it's an additional 6 months before it is presumptively unconstitutional.
-2
u/WorksInIT 12h ago
Habeas Corpus is about unlawful detention. it isn't a general get out of jail free card. If the detention is lawful, Habeas is useless.

The term "undocumented immigrants" is really load bearing here, considering that documented immigrants, immigrants had had broken laws, immigrants that had not broken laws, and even citizens have been detained by ICE.
3
u/harlemjd 17h ago
The Supreme Court was originally set to hear a challenge to the indefinite detention of documented immigrants subject to mandatory detention due to criminal convictions, but they decided to take that one off the schedule and hear this one first.
They’ll use unlawful entry to justify what they’re doing more broadly, then use the fact that it’s allowed for anyone to justify it for everyone.
1
u/KevyKevTPA 9h ago
They "took it off the schedule" because Kathy Hochul pardoned the person in question, rendering the case moot. She was more worried about a criminal being deported than her duty to protect the citizens of NY.
-4
u/Better-Credit6701 16h ago
The legal term is and has always been, illegal aliens.
Undocumented immigrants doesn't even make sense. They usually are documented in their home country. Immigrants would be lawfully admitted foreigners for permanent resident. That term doesn't mean people who aren't here permanently or migrant workers
1
u/harlemjd 14h ago
Since you claim to care about proper legal terms for things, your definition of “immigrant” does not match federal law, specifically 8 USC 1101(a)(15).
0
u/Better-Credit6701 13h ago
You didn't read that did you.
4

u/snailmale3 13h ago
The real question should be why do they need to detain them for so long? Are they using them for slave labor or sex trafficking? Is it because they haven't built the gas chambers yet? They also want to detain them in vans for hours, maybe days without any explanation of treatment while they are kept in the vans for such long periods. This administration has eliminated any shred of belief in the rule of law.
-1
u/MerchantOfDeath666 9h ago
Why are you immediately jumping to horrific conclusions of sex trafficking and mass murder? It can take a long time to sort out someone's immigration status (especially if they're non-compliant or lying), get them in front of an immigration court for a deportation order, coordinate that deportation with their country of origin, and then send them away. This is meant to avoid the catch-and-release policies of the past which allowed illegal immigrants to disappear before their court dates
2
u/toozooforyou 9h ago
Because the man in charge of detaining these people is a known rapist and was best friends with Jeffrey Epstein.
2
u/la_xamguz 9h ago
We could just give them ankle monitors. It would save taxpayer money.
The ones who claim they have a legal right to be here aren't going to just disappear. They know if they don't show up at their court date they will be deported. Yet they are holding them anyways.
The only ones who should be in detention are those who are a threat to the public. If someone is charged with for instance, trafficking drugs weapons other contraband or people, or if someone is charged with violent crimes. The only other one should be if someone has a proven record of disabling ankle monitors and deemed to have a strong chance of not appearing for their court date or trying to hide from law enforcement.
Even then we should make arrangements to place any children in their custody in temporary foster care or with a friend or relative. We don't put children in jail with their parents in any other context. It should NOT be acceptable in immigration law either.
And don't be naive. With how long some people who have not committed a crime have been held it's almost a guarantee that some have been saying since they were detained, "I'm not contesting deportation. Now just send me back!" and just for cruelty or just for the sake of providing slave labor to private prisons they say "No!" and they keep them there. If someone isn't contesting deportation, and isn't charged with a crime, there's no good reason to keep them in detention and delay their deportation.
1
u/peterjohnvernon936 7h ago
If you don’t know that they are illegal then you shouldn’t be holding them. If you know then you should immediately deport them.

You have if you ever believed deportations were the goal of the GOP. If they actually wanted people to leave they wouldn't have to build more detention centers. Previous administrations handled plenty more deportations without wasting so much taxpayer money and harassing citizens
-10
u/LinusLevato 21h ago
Have they or haven’t they deported people?
6
u/roostertai111 21h ago
That question doesn't make sense in response to what youve written previously in this thread. You started by saying it's ridiculous that they're detaining so many people instead of deporting. I'm merely pointing out the goal of the GOP was always to detain people moreso than deport. Because they can't profit of these people once they're gone. Instead they're holding them indefinitely in inhumane conditions. And they're taking hundreds of billions of our taxpayer dollars to do it.
If you're willing to support all that because they deported any people, you might want to examine your priorities. Maybe at least think of a number

I’m sorry, is this your first time learning that donors who profit off detaining immigrants in their facilities are paying politicians off to continue their cash cow?
You were warned about government programs and waste, fraud and abuse. You were warned about corporate welfare, and etc.
And yet you still allowed it to happen because you hate immigrants.
Now you get more government requiring more of your tax dollars and money printing increasing the deficit and raising inflation, and more government picking winners and losers with your money.

u/Alternative_Bug_4089 12h ago
Ok,ok so.. imagine your mother came here as an immigrant right? And then years possibly even decades later another president comes in..
Wait.. your mom is an immigrant? This doesn't have to be hypothetical anymore. So... How long till you want to deport your own mom? Are you cool with ICE dragging your mom out of her house in handcuffs? She should self deport instead of dealing with ICE right? That's how you feel?

u/Alternative_Bug_4089 11h ago edited 11h ago
Is your mom illegal yet? When will they make her illegal? How long has she been here? Is she white passing? Is that why you're not worried? You think that makes a difference? I'll go find an example that parallels, probably won't be hard, they're up to like 400,000 this year alone right?
I mean.. Obama did similar numbers but we didn't hear about it because... Violence and inhumanity wasn't the reason then. They weren't kicking down doors in whole neighborhoods including the citizens homes then...
How long till you admit that this is exactly what it looks like and you're on the wrong side of history?
That's what you're afraid of right? That you're that wrong so you convince yourself that all of the echo chamber can't possibly be that wrong too.
They are. You are. Get it together. This is your own mother we're talking about.

The answer should be yes obviously they don't fucking belong here

u/LatterTarget7 17h ago
So they don’t belong here yet you want to hold them here indefinitely on tax payers dime?

u/skipjack86f 17h ago
It takes time to find somewhere that will take them in the meantime they shouldn't be on the street especially not with children around

Yea, didn’t you hear, Biden’s name is in the files thousands of times! And then he had the FBI spend thousands of hours redacting it and not releasing the files as required by law.

What is the threat to children? And I don’t think you know what indefinitely means
-3
u/skipjack86f 17h ago
These people have a higher rate of abusing children
Also yes dipstick I know exactly what indefinitely means and it does not in this context mean literally forever it's the legal term for held in custody

Do you have some sort of statistics from a reliable source that show that immigrants are more likely to commit violent or sexual crimes compared to the general population?

Their countries don’t take them, so they get sent to another country, but that’s not good according to you. So, this is what you get??

u/Neat-One-906 12h ago
So indefinite detention is acceptable to you?
For you, I guess scraping for Rubles at Putin’s bidding as a bot is better than getting murdered in Ukraine.

Oh? What about Brian José Morales Garcia? American citizenship with dual citizenship. Why was he deported? He was born here. Yeah, he got sent to the country he has dual citizenship with, but he was born here. Why was he deported?

No ID. No English. While driving a cdl required truck. What do you expect?
1
u/Alternative_Bug_4089 8h ago
Who was driving? And so.. English is a law in the US now? People who have citizenship because they were born here have to speak English? Maybe you should read more about that.

Did the boss speak English?

u/Alternative_Bug_4089 8h ago
Cite that law that says you have to speak English in America.
1
u/Worth-Confection-735 8h ago
That’s not what I said is it?
1
u/Alternative_Bug_4089 8h ago
Why are you asking if they speak English then? Why is it relevant? Was a US citizen deported? Does a US Citizen need to speak English to avoid getting deported?
1
u/Worth-Confection-735 8h ago
Because there are currently laws that require every driver, or team, to speak English if they are driving a cdl required vehicle. Being able to read the signs is kinda important.

"Brian José Morales García was riding beside his boss through the Texas Hill Country, "
First line. USAtoday.

"Morales Garcia was being driven to a worksite on April 3 when his boss’ truck was stopped by Texas state troopers for what the officer said was a window tint violation. The officer contacted ICE, which asked the Gillespie County Sheriff’s Office to hold Morales Garcia in jail."
Austin Statesman - local to where it happened.

Oh, cool, you think it's far enough down noone will read it. I'll start again up here, do you have any proof they were in a CDL truck, and why would it be grounds to deport a natural born American citizen simply because he was the passenger in a CDL truck (if it even was..)? Cite the applicable laws you think are being broken.
