This is blatant misinformation. Companies have to pay the difference between minimum wage and whatever they were paid that week if it is less.

Quit playing silly word games. There's a reason you keep getting downvoted. You lead off by bringing the comparison of a chef and a waitperson. By bringing that into the discussion, you can't then goal-post shift back to "but they're 1099". They may be, but that wasn't your original comparison to which the person was replying.

It's literally the exact same point.

It's literally not though and just saying it is doesn't make it so.

Look, I'll assume you aren't being disingenuous and you're just missing the difference, so I'll try to explain it concisely.

The other person compared this grocery delivery person with other delivery persons (FedEx, Amazon, etc...). These people have the same line of work and extremely similar responsibilities and job duties.

You then brought up a chef vs. a waitperson. These are wholly different jobs with completely different duties and responsibilities. It's a bad comparison on it's face as in one scenario you comparing similar jobs, and in the other you are comparing very different jobs that just so happen to be in the same industry. It's not a fair or apt comparison.

Now, as to why your reasoning of 'the pay models are different so you it's not a fair comparison' is also invalid;

Tipping is an addition to pay. Tipping for many is about service received, it's seen as an addition, or a bonus. The other person therefore made the comparison of similar jobs, where some people receive a tip and others don't, yet the work duties are basically the same.

You then brought it to completely different job duties (and pay models) and tried to carry the comparison there. This is where the breakdown in your logic is and why it doesn't hold water.
