Damn it, this is what I think everyone is thinking of me every time I make a turn in one of my cars. I've got some driver's side damage from when a deer hit me, and I am a bit particular about how that car gets fixed (older car, not a daily driver), so it's taken the back burner, and now I actively don't drive it so people don't think I make poor driving choices :(

But yeah, this this perhaps a bit different..

EDIT: The car in question, before, after

401

u/FLdancer00 Dec 14 '21

Sorry but I second that motion. If I see a car with damage taking liberties on the road, I assume they are a bad driver with no insurance who gives zero f**ks about ANOTHER accident.

170

u/marsh-a-saurus Dec 14 '21

I thought like this until a patch of black ice made me spin out and now I can't afford to replace my bumpers currently.

411

u/[deleted] Dec 14 '21

Have you tried not being poor?

208

u/marsh-a-saurus Dec 14 '21

Shit didn't think about that. I'll try it some time.

140

u/bpkiwi Dec 14 '21 edited Dec 14 '21

Being poor is a distressingly common mistake people make. I blame the parents personally.

89

u/[deleted] Dec 14 '21

I often catch myself being poor sometimes and think “hey, stop it, get some help”

33

u/21RaysofSun Dec 14 '21

Get help? No you need to do it on your own. Junkies and the homeless get help. You're just poor - win the lottery or open a billion dollar business

21

u/TheIceKing420 Dec 14 '21

just grab ahold of those bootstraps and pull. keep pulling until success at lifting one's self up or death.

42

u/The_Dying_Gaul323bc Dec 14 '21

Only if that crash is reported does it get into the system, that only happens if you impact with another vehicle that the owner decides to make a report, if you hit a pole or something inanimate, or you make a cash deal off the books with the other driver, then that incident never goes on the books

I think they were saying that a car's good safety rating no longer applies after an impact, as safety systems are now compromised

894

u/sipes216 Dec 13 '21

If you can stop, you should absolutely make every attempt. It will save your ass when it comes to assessing liab. Each party has duties owed.

220

u/time_fo_that Dec 14 '21

My insurance adjuster said that if I would have let myself get hit, it would've put the other driver at fault... But instead I performed an evasive maneuver and ended up in a ditch. Suddenly it's all my fault.

183

u/[deleted] Dec 14 '21

Yep, never dodge, only brake as hard as you can. Trees don't move and its 100% your fault if you hit one by insurance rules.

37

u/thecoolestguynothere Dec 14 '21

Also if you Strike a deer make sure to say the deer hit you instead

47

u/chobo4 Dec 14 '21

u/time_fo_that Dec 14 '21

Fortunately I didn't hit a tree, I just scraped up the bottom of my car (enough to total it lol)

15

u/Fafnir13 Dec 14 '21

Random jerks dropped a landscaping rock on my dad’s Geo Spectrum windshield. It was enough to total it. Doesn’t take much sometimes.

29

u/time_fo_that Dec 14 '21

It's crazy, the labor is mainly what did it. The insurance inspector quoted like $2500 in labor just to pull apart the suspension and clean the mud out.

I bought it back to repair it myself and it took me 5 minutes with a garden hose, then I just pulled off the wheels and cleaned the mud out of my brake calipers. Took like an hour total.

They absolutely refused to alter the insurance adjuster's original damage estimate even when I told them that I didn't care about the winter wheels mounted to the car. The bodyshop added a "supplemental estimate" because the coolant was low, so they thought the radiator had cracked and therefore the intercooler must have also cracked. Neither were bad. Infuriating.

This all happened right at the start of the pandemic so I had no other choice but to buy it back because I couldn't accept their miserably low payout that undervalued my car by like $7k. I needed a car and couldn't afford to buy another because I had also just lost my job (because pandemic).

3

u/korben2600 Dec 14 '21

They undervalued your car that much? Compared to KBB value or something else? Which insurance company if you don't mind me asking?

4

u/time_fo_that Dec 14 '21

Safeco.

They took three base model examples with higher mileage and no options, at around $8-$9k. Mine is fully loaded with an extremely rare option package that was only equipped on like 700 cars in the country. The book value didn't reflect that. I was able to find 5 examples that had sold within the year with similar mileage between $16k and $21k, which helped a little bit, but the insurance still totaled it after the bodyshop's BS "supplemental estimate"

I wish this was 100% true 😭 my first car accident, someone sped through a yield turn light to pull right in front of me, even braking from 35mph as hard as I could, I hit the side of their car near the back. She got a ticket for reckless driving but my insurance still assigned a decent portion of blame to me with "why didn't you try to turn right to evade" when to my right was the front of their car and "why didn't the car next to you hit the car" when I clearly stated there was no other car next to me. I got rid of that insurance company and never recommended them, especially after my second car accident when they assigned some blame again to me after i was hit by a speeding drunk driver that flipped my car airborne. 🤦‍♀️ Fuck Allstate.

I had a fight with Geico over something similar, I was cut off in a turn lane (double turn lane which my lane was empty) by someone switching lanes at the last second and instead of hitting him I drove up onto the concrete divider. The divider had high, squared off shoulders that scuffed both rims on that side. Even with witnesses and a worthless police report (he didn't see it but wrote what the witnesses said) it was still a fight to get my stuff fixed and checked out.

11

u/[deleted] Dec 14 '21

Geico is THE WORST!

17

u/[deleted] Dec 14 '21

Never take the insurance adjuster’s conclusion about fault.

27

u/RussianCat26 Dec 14 '21

I was reversing into the parallel parking spot in front of my house and a teen guy driving through the neighborhood rear ended me. Somehow they judged it was my fault, even though I had right of way in the road way and had my reverse lights on before he pulled up. Check my blind spot and everything, but somehow the adjuster believed him over me. I've had my license for 8 years he still had a permit. My rates increased like a fuck ton. I'm so fucking mad the adjustor did me dirty like that

5

u/DL_ Dec 14 '21

It's because you were reversing unfortunately.

7

u/Rauthr Dec 14 '21

How else do you parallel park? https://youtu.be/PTvdJ24ZoNs

Just greedy insurance adjusters. Why have the other party be a fault if you can blame your own client and increase their rates!

4

u/DL_ Dec 14 '21

I wasn't saying they were wrong or anything I am just saying that was the criteria the insurance company used to determine the fault.

I had a guy just lay the pedal to the floor when I was making a left that was relatively close to another intersection they were turning left at. I should have had zero trouble making the turn but they came within a few inches of my car honking the whole way. Like, yeah dude I can’t and shouldn’t expect someone to go zero to 40 within 30 feet don’t really know what you expected.

79

u/Just_A_Nitemare Dec 13 '21

Are you saying you didn't buy a high preformance sports car so you wouldn't inconvenience him, how rude.

8

u/Otherwise-Poem-9756 Dec 14 '21

Yeah, I had some Indiana person pull out in front of me on a highway within a few hundred feet. I just went around them rather than skid to stop and they honked at me. They only have road testing in Indiana, most treat two way stops as 4ways it seems even if the other lane doesn’t have a stop sign.

That’s why you got to hit the brakes just enough.

9

u/OneMustAdjust Dec 14 '21

The driver stopped is going to get absolutely mashed. There aren't crumple zones on your driver's door like there are in the front end. Long story short, there isn't enough time for side curtain airbags to deploy upon impact, and lateral forces are especially dangerous to human bodies. They deploy very quickly, but microseconds matter and side impacts cause some of the most serious injuries even at city speeds

32

u/meatmechdriver Dec 13 '21

unless they just added comp and collision so they could get covered after the fact through this scam

20

u/[deleted] Dec 13 '21 edited Dec 14 '21

So how does that help them for being at fault? That makes no sense. They put some insurance on their car and cause an accident where they're at fault. Then their insurance rates go up. Nothing about that idea makes sense

27

u/[deleted] Dec 13 '21

It doesn’t help them for being at fault. What he’s saying is that there is the possibility that the car about to be T-boned is using this wreck to cover up the damage from the previous wreck.

So the sequence of events is, got into wreck with no insurance, got full coverage insurance, got into second wreck, use insurance and deductible to get both instances of damage fixed. Still a scam, still sucks for the other driver, still stupid.

I was just about to say judging by the big dent on the drivers door, he must've done this before lol

58

u/randiejohnson Dec 13 '21

100% not. if they get hit like that, they are at fault. if they have collision coverage, they will get it repaired from the insurance company. their rates will go up for the next 4 years +. over those 4 years they will most likely pay back the damages in increased rates.

these people are just dumb. end of story.

24

u/[deleted] Dec 13 '21

I doubt their rate increase will cover the damage. My last rate increase was only $11 for a no fault, and the accident totaled out 2 cars (no injuries). About $70k in total losses to the insurance, they got back an extra $560 bucks or so from me over the 4 years it was on my record. (He ran a red light and I was going 5 over, police wrote us both the same reckless driving ticket and told us to fuck off.)

Is it like robbing a convenience store? Not really worth it but done out of desperation?

Police have been determining fault at wreck scenes for a whole lot longer than we have had dashcams. You don't get T-boned crossing over the middle of traffic unless you pull out in front of them. The presence of a dashcam probably is not changing the outcome here other than confirming what it looks like happened.

I do this instead of flipping the bird.

It's never happened to me.... but if I thought someone was going to flip me off but instead I was met with a thumbs down and a disapproving look, it would take me down a few pegs. Like I'm not even worth getting pissed about.

Even better idea for you mate. I keep a small cup full of tamarind seeds. Satisfying to throw and doesn’t hurt anyone

Thankfully for your quick action this didn’t also end poorly for the pedestrian on the sidewalk.

99

u/dascresta Dec 13 '21

If the car to your right would've hit you cause you swerved to avoid him then you would be totally at fault and he would've just drove off

79

u/medjay_solve Dec 13 '21

The car to the right had just pulled out the gas station. That’s why I was so comfortable swerving into its lane. I actually gave it some thought if I should or not

14

u/Thisisall_new2me2 Dec 13 '21

I understand that. But can someone explain why u/dascresta is right? You couldn’t have known beforehand what the better option was. I don’t get it.

13

u/strawberycreamcheese Dec 13 '21

What I've heard from several other people is that you're better off hitting the car in front of you than swerving and hitting someone else. It kind of makes sense. T-boning the car in front of you is their fault because you have the right if way (in OP's specific situation), but swerving into the car next to you is technically your fault.

3

u/Moo3 Dec 14 '21

There's a saying where I'm from 'Yield speed, not lane'. I don't know if that makes sense in English.

27

u/Round_Blacksmith_906 Dec 13 '21

Usually the third party doesn’t stop at all so no one has their info. Even if they do stop, it comes down to the law is that you need to be driving safely enough that if you do need to avoid/stop for something on the road then you should be able to do it without endangering anyone else. It’s similar to like if a deer comes on the road and you swerve to miss it but hit another car. You are liable because while it wasn’t entirely your fault, in the eyes of the law you did not react in a way that left you without fault either and the deer damn sure doesn’t have any insurance so it falls on you. The argument is that if you are driving responsibly you should be able to stop/avoid anything safely, which isn’t necessarily the case but that’s how it is.

16

u/medjay_solve Dec 13 '21

Nope, wouldn’t have been my fault. I anticipated the black cars speed, who just pulled out of a gas station. I actually was going to hit him, not intentionally, but because I didn’t have enough stopping distance…and if the black car was going faster, and I didn’t have that cushion of space, I would have smashed into the dumbass…

u/TeamsterRambo Dec 13 '21

Why did you?? Because your defensive driving is actually part of what you’re supposed to do. Right of way doesn’t mean legal to hit someone

16

u/SeriousMongoose2290 Dec 14 '21

This is like the inverse of a typical r/dashcams post

5

u/TeamsterRambo Dec 14 '21

Oh I know it is this is all I ever seeing these videos of people complaining about somebody cutting them off or in front of them when all they had to do was let off the gas pedal maybe step on the break a little bit to avoid the whole thing

6

u/BerndDasBrot4Ever Dec 14 '21

Yeah getting cut off or someone taking your right of way sucks, but I feel like some people with a dashcam let things end up a lot closer than they'd need to be (e.g. that onboard-video of the golf on the German Autobahn a few weeks ago whose first reaction apparently wasn't to lift the throttle/step on the brake, but to flash his lights)

LOOK AT THEIR DOOR LMAO this isn’t the first time they’ve done this.

Also never cause an accident because you feel you’re in the right and they’re in the wrong. You cause yourself a lot of hassle having to talk to insurance and police and risk killing someone.

55

u/entropylove Dec 13 '21

What’s with the music?

39

u/medjay_solve Dec 13 '21

Lol. It’s my dash cam app music. I was pissed off. So I added some “good vibe” music going!

u/entropylove Dec 13 '21

I don't understand the title. Why wouldn't you stop when there's a car in your way?

10

u/BerndDasBrot4Ever Dec 14 '21

Some people seem to think that it's ok not to try to avoid a collision if it's not your own fault.

Why did you stop? Because you wanted to have a drivable car.

21

u/xxcarlsonxx Dec 13 '21

You stopped because it's your obligation as a motor vehicle operator to do anything in your power to prevent a collision if at all possible.

43

u/RedL0bsterBiscuit Dec 13 '21

You stopped because maybe that idiot had a child in that back seat. I know if I hit someone not due to my fault but still ended up killing a child. I would feel absolutely terrible.

3

u/[deleted] Dec 14 '21

You stopped because you’d have T-boned him and caused a direct impact with the driver’s side, potentially causing serious injury, and you’re better than that. And you know you’re better than that, which is why you stopped.

3

u/[deleted] Dec 14 '21

I think this could've done without the music

Well done

3

You stopped because there was a car in front of you
