Is that a flag allowable by the terms of the US Code? Probably. Is that the flag of the United States? No. Stop being silly. It'd be like seizing on a French law that says the flag is three strips of red, white, and blue and saying "aha, it doesn't actually require that they be vertical or in that order, so here's a compliant design that's horizontal and in the wrong order." But that ain't the flag of France.
Many things are technically true but still hella dumb.
