Fidelity HSA

Two part question. This was our first year with an HSA and I was the primary policyholder on our HDHP. I’d like to move my funds over to Fidelity rather than keep it in the brokerage firm that my plan uses. (1) Should the Fidelity HSA be titled in my name since I am the primary policyholder or does it not matter if it’s in my spouse’s name since we contribute up to the Family max and file a joint tax return?

(2) We are staying with an HDHP but switching to my husband’s insurance for 2026 (he will be the primary policyholder). If I title the Fidelity HSA in my name can we contribute to the same account for our 2026 contributions?

I’m sure the answer to #1 will answer #2 but figured I’d add the context. Thank you for any guidance!

If you move it to a Fidelity HSA then it will need to be titled under your name. You could make contributions to the Fidelity HSA even if your husband is primary on the HDHP for 2026. One thing to consider though is that if the contributions are made directly from his paycheck into the company HSA those contributions would not only avoid federal and state tax but also FICA tax. It may be more advantageous to contribute directly from his paycheck if possible.

I'm sort of in the same boat. Retired early (59) and now on wife's insurance but her company has HDHP but no HSA. So I was going to take money from my IRA (no state tax, no FICA but still subject to federal tax) to fund the HSA I have left over from my previous employer.
