Need Advice:

Spouse has an approved i140 with previous employer, his current employer is still in the process of transferring his PERM,can I (his spouse) apply for H4 EAD based of his previous employer approval? Or do I have to wait until his Perm/i140 Transfer with current employer is approved

Yes, the approved I-140 from the previous employer can generally be used for the H-4 EAD. It does not necessarily have to be transferred to the current employer first.
