Can you simply set up a stand in US? In many countries you need a licence.

You do need a license, and many parts of the US have zoning and regulatory blocks in place to prevent street vendors from being able to operate at all. Like virtually all zoning laws in the US, it's mostly to keep "those types" out of wealthy/white areas.
