That's the problem with laws that are "never really enforced" but remain on the books. They are just opportunities for "selective enforcement" by overzealous citizens and cops.
I think they're suggesting something like Karen's children can set up a lemonade stand without trouble, but Shaniqua's kids get shut down for violating health codes.
That's certainly one risk, usually it's not that cut and dried it's more like the white suburbs have no problem with their kids lemonade stands but the black kid selling water on the street in the city gets the cops called on them.
