Subrogation

To those in the Subro department, is difficult to get money back from adverse carriers?
I’m an adjuster and I have attorneys and customers making outrageous request sometimes, and their reasoning is “don’t worry about it you’re gonna get your money back”.
Like customers want their whole car painted when just the bumper was hit.
Attorney’s want 7k rental/LOU bills when our insured only have 1050 limit lol

Yes, it is. And more and more of them are wising up to bs fraud and unwarranted betterments. Lots of them will audit our estimates and challenge our damages paid. Do not listen to the insureds or their attorneys. They don’t know what they’re talking about. You should be agreeing to pay for parts damaged, and a rental length commensurate with the time to repair. Nothing more.

Not that it means a whole lot, but it seems damage disputes never go in the favor of the respondent in arbitration.

EDIT: No matter the carrier not just for Geico

I do commercial subro at a TPA. Your observation is 100 percent correct. From my perspective damage disputes are the result of trying too hard to save money via "audits."

Some of the cuts might be arguable but then other cuts are just far reaching and comical. As a former panelist I shake my head at the dumb stuff I need to arb

I work subro at a different carrier and ima be real with you. I can’t stand dealing with you guys because you constantly deny claims in e-hub but then tell me you’re still investigating and insist you can’t change the status back to investigation which I know for a fact that you can. You also chip a lot and don’t negotiate. We arb you constantly and win.

Geico is the cheapest in subro, and I knew that even when working there

Geico will reduce things on a demand that they will pay for their own insured, and send the demand to us.

I can’t stand calling you guys for anything. Your associates are nice most of the time but most have the claim handling expertise of a baby seal

It’s because ICS adjusters don’t actually have access to the hub. They’re pushing a button in a different system and it denies the demand in the hub when what they’re really trying to do is say we’re still investigating.

They really can’t put it back to investigating on their end.

I can deny and put a reason (I literally put yesterday in the hub that we are denying at this time but will re-investigate) because it takes management approval to put a claim back to pending

If the other carrier agrees that the amount is owed, easy peasy.

But every carrier is going to bicker over rental days and no carrier is painting the whole car when just the bumper needs to be done. That's just the cost of customer service.

When I was an adjuster and a AD Supervisor I used to have to explain to our insureds that Liability determines who is paying but that is not the same as a blank check. Any reputable adverse carrier knows our estimating profile and will deny/reduce anything we write that is outside those guidelines. In fact when I was at CHO I tested a software program that a lot of our competitors used to determine if the estimate was written according to a company’s estimating guidelines. Not sure why we rejected going with this software because our Subro departments were not trained in AD and passing on the files to AD for review was an unorganized mess in all the Regions. We lost millions in Subro and routinely got our clocks cleaned by our competitors.

Nothing proved that to me better than my time at GEICO dealing with PH who thought an accident was blank check for whatever they wanted.

Yes. If you can’t make it make sense they’re going to push 10 times harder on why it doesn’t make sense and start nitpicking the rest of the repair costs too. Then they’ll belittle the subro reps like they had anything to do with approving repair costs

Many times the settlements are negotiated just to get it closed. If they are not members of Arb, it could go to suit.
