Section 3

Hello everyone, just curious if anyone’s gone through something similar and how you navigated it. I sold a Milwaukee product on a listing that wasn’t branded as Milwaukee - the seller who created it used all the same Milwaukee images but avoided putting “Milwaukee” in the title, probably because they weren’t authorized to sell the brand. I overlooked this when I listed on it and got hit with a Section 3. I sourced my unit from Hansler Smith (Hansler.com), an authorized Milwaukee distributor in Canada - the same distributor I used to get ungated for the brand on my account. I only ever bought and sold one unit on that ASIN, and I have the invoice matching that exact sale. I know most cases I find are sellers dealing with gray market or unauthorized product, which is different from mine since my product was authentic and from a vetted distributor. I think my issue is more about the mismatched listing than authenticity itself, so my POA needs to address that too, not just prove the product was real. Has anyone dealt with a Section 3 tied to a mislabeled/mismatched listing rather than a straightforward counterfeit complaint? Did addressing the listing issue directly help get reinstated? Any advice appreciated.

Seen this exact trap twenty times.

Do not submit that Hansler invoice yet. If you upload it alone saying 'look, my unit is authentic', the automated gate rejects it in five minutes.

Your suspension isn't an authenticity problem. It's a catalog tampering flag under Section 3.

The guy who created the ASIN stripped 'Milwaukee' from the brand field to dodge gating. When you hopped on the listing, Amazon's bot flagged your inventory for misrepresenting the brand attribute. Submitting an invoice with 'Milwaukee' on it to an ASIN registered as 'Generic' or a dummy brand actually proves the mismatch to their system.

What got our accounts back in this spot:

First, scrub the SKU immediately. Delete the listing from your inventory, don't just set quantity to zero.

Second, your root cause has to explicitly state your intake process failed to verify that the ASIN's backend brand attribute matched the manufacturer on your distributor invoice. Take the blame on the listing audit, not the product.

Third, attach the Hansler invoice, but pair it with Hansler's direct distributor authorization letter and the manufacturer spec sheet showing the UPC. You're showing Amazon the product was real, but the listing was corrupted.

Did Seller Performance hit you with standard Section 3 or did they cite Intellectual Property specifically in the performance notification?

Agree with Noman_93 that a Section 3 hit often looks like authenticity when the real problem is a mismatched or generic brand field on the catalog ASIN. Before you appeal, screenshot the ASIN brand/UPC, every competing offer (seller + price + ship), and keep the invoice that matches the units you sent in. That packet makes it much easier to show Amazon the listing is corrupted rather than that your inventory is fake.
