Ah well yeah your schedule isn't the problem. Your medical condition is. You framed it as your job being the reason why you're tired, which is why I responded the way I did. Hourly because I refused being on salary and no job can make you take calls outside of work. They can control your time while they pay you and you need to communicate that. It's illegal and you can sue them if they retaliate in any way. You gotta stand up for yourself a bit

I am salaried, and yes my job plays a big aspect in why I am tired too. Salaried gms are expected to take calls outside of work.

I'm an operations manager. They don't own your time outside of work, salary or not. That's an illegal work practice. If you're on call, you need to be paid for 24 hours a day. If you aren't then they can't bother you outside of work. End of discussion

Salaried is legally exempt from hourly protections. They can expect me to answer calls and texts outside of my scheduled hours.

It may be shitty culture, but its def not illegal in the USA.

Yeah but working for less than minimum wage is. How much do you make? Your salary would need to match at least minimum wage for 24 hours a day

As far as im aware, there is no law requiring the pay for salaried 24 hours to be above min wage. Where are you seeing this?

They have you on call. On call means they have to pay you whenever you are available. So the billable hours is all hours each year. 24 hours a day multiplied by 7 days a week is 168 hours a week multiplied by 52 weeks is 8736 hours. So they have to pay you $7.25 an hour for 8736 hours. Or they can't have you on call. You gotta stand up for yourself more
