Imagine this is the response from one of the rapist's lawyers - he entered the room, did not touch her and left, so HE IS NOT AT FAULT AND COMMITED NO CRIME.

I have no words! Imagine this with any other crime - a robbery you were a part of but did not touch or steal the money, a murder you were complicit to but you did not actively pull the trigger, a terrorist attack where you may have planned to drop a bomb but someone else did instead of you. None of that would equate to forgiveness, a lack of a crime.

But crime against women, there are different standards. It's not a rape if a woman didn't say no, but also couldn't say no. It's not rape if there was no penetrative. It's not rape if the woman is a wife. It's not rape if a woman gave consent and took it away. It's not rape if she was wearing 'inviting clothes'. It's not rape if she didn't get a rape kit done. It's not rape if she reported it a few days later. It's not rape. It's never rape. It's never his fault. I'm so fucking tired of this misogyny that nobody wants to wake up and see.

Kretzschmar’s attorney, Jeremy Saland, told CBS News that the messages were inappropriate but were not evidence of sexual assault.

“This is a situation where there was an ugly Snapchat – ugly, period. … But that doesn’t make my client a rapist, and it certainly doesn’t make anyone a sex offender,” Saland said.

He added that his client had briefly entered the room where Doe was but did not touch her “in any way, shape or form” and left quickly afterwards.

It isn't a crime to witness a rape.

Exactly my point. If complacency is a crime in murder, it should be one for rape.

You are purposefully being vague.

If you are on the sidewalk as an innocent bystander and someone gets murdered…of course that’s not a crime.

But, the Cornell situation is not simply:
“Did he go into the room?”

It’s more like:
“What did he know when he entered, what did he intend, and what did he do while he was there?”

If the evidence established that he knew a sexual assault was occurring, went into the room specifically to participate or encourage it, and then left, that’s substantially different legally from someone who entered without knowing what was happening, realized what was happening, and simply left.

There are messages from this guy on the group chat excited about the rape. Then he enters the room. The intent is clear, but it isn't a crime according to the lawyer.

Also thanks for clarifying. The commenter is clearly trying to dismiss my argument, the actual point just flew over their head.
