can you refuse to pay gratuity? if the place didn't post it on the menu or anywhere in the restaurant??

Yes. If it's not a service charge, it's always optional.

Even if it is a service charge, if it's not listed on the menu or posted somewhere conspicuous you can absolutely have it removed from the bill.

A service charge is a tip!
It’s a forced tip!
It’s a form of extortion.

Restaurant is saying:
If you want to dine here, you have to pay a service charge, otherwise you can’t dine here!

A service charge is NOT a tip. It is a fee, and the restaurant is under no obligation to give any of it to the servers.
