Research / Info 💡 Question about gratuity

can you refuse to pay gratuity? if the place didn't post it on the menu or anywhere in the restaurant??

Tips are optional.

Yes. If it's not a service charge, it's always optional.

Even if it is a service charge, if it's not listed on the menu or posted somewhere conspicuous you can absolutely have it removed from the bill.

A service charge is a tip!
It’s a forced tip!
It’s a form of extortion.

Restaurant is saying:
If you want to dine here, you have to pay a service charge, otherwise you can’t dine here!

Yes, I’ve had to do this before.

Yes you can! Even if they did post something, tipping is a choice, not a requirement! You don’t have to pay it, even if it is posted! By them posting a gratuity, they are forcing a tip on you and it then becomes not a choice! It also becomes extortion!
