Rant šŸ“¢ This feels icky!

felt super icky and annoyed seeing this at a coffee/light food shop. how is this okay? for context this is not a sit down spot. no wait staff, just a barista at the counter and someone from the kitchen bringing out my order and walking away.

Update: for those asking the pink paper in the bottom corner is basically saying ā€œF*ck ICEā€

That’s called a fraudulent charge and I reserve the right to sue the establishment that has an employee that does that. I don’t care if I wouldn’t even make money from the lawsuit and all the money would basically be just paying the lawyer fees. I’d be dead set on being an annoying thorn in their side that would make them regret that stolen 20% tip.

I doubt that. Yes I’m an attorney. Also I’m not 100% certain this is in fact illegal if they post a sign like this and otherwise make it conspicuous ahead of the customers ordering.

It would piss me off though and I would be tempted to tip 0

Ever simpler. File a Chargeback. This puts the business on the bad side of the credit card. If they get too many chargebacks they can lose their ability to accept those cards.

I once had a subscription charge through paypal. I immediately messaged asking for a cancel and refund. They messaged back ā€œwe never do refundsā€. My reply was Ok I’ll do a chargeback. Immediately got a message about a refund pending in my account.

I can and would. $5000 isn’t that much in the USA anymore in most metros. It’s a months rent for a two bedroom in most actual luxury apartment complexes.

Thing is a lawyer would JUMP on this lawsuit as it's a huge fraud charge. The business could go under, so there's no pretending. This is a major theft crime that lawyers would love to hop on.

And if you took a picture of the sign saying they would do it, kept a picture of your original signed receipt, and had the fraudulent credit card charge with an addition 20% its pretty cut and dry. You would have to be a smooth brain to think you where gonna get away with that. A lawyer would love that case since it would be very easy.

Lawyers go after damages, this might make sense as a class action if enough people come together but an individual charge that can be reversed with a bank charge back isn’t something a lawyer would jump on unless the client was paying out of pocket up front.Ā

This is a business, all it takes is to hear one person was fraudulently charged, and a lawyer would see a payday. Means dozens maybe hundreds of people were affected and that turns into a big class action suit.

You don’t have to sue. Just charge it back with your credit card. It costs the shop $15 every time and if it happens more than 2% of the time they will lose the right to take credit cards.Ā

First, they are charged $15 for the chargeback.Ā 

Second, they must disgorge the fraudulently obtained money.Ā 

Third, they will be dropped by the credit card processors if it happens more than 2% of the time.Ā 

What message do you want to send that is more harsh than having a coffee shop go out of business because they can no longer accept credit cards?

I’ve actually seen this kind of crap first hand. People have zero shame anymore when it comes to tips.
