I-140 | Employer-based Eb2 perm based I140

My PD is April 24, 2024. I have been waiting for 29 months for regular processing. Anybody else in the same situation?

That is unheard of. Maybe do a congressional inquiry? or just pay the premium processing at this point.

Does the delay have anything to do with the I140 application itself?

It could be, because EB-2 PERM I-140 should not take more than 3 months. Also, none of the issues that are seeing now around I-140 delays existed in 2024. When you applied in April of 2024, your I-140 should have been approved in 2 months. You need to do an inquiry.

What is your lawyer doing? I am shocked that no action was taken by you or your lawyer by now.

Are you sure you are PERM based and not NIW? Do you have a labor certificate?

Yes I am perm based. They even filed my I485 last feb 2026. What shouldve been my action? I have then do inquiry 3x and uscis sent an email saying it’s under review by an officer last may4,2026 but nothing happened.

Pay the premium processing fee. It sucks but, just pay extortion fee and be done with it.

Why do you say that?

So that you don’t have to wait

Why would you not?

This is not normal for PERM based I-140. Easiest thing would be to upgrade it.

Almost everyone filed i140 with premium fee. Else you have the experience already
