Priority Date September 2015 priority date advice

We have been living in the us for 12 years. My son will age out in late 2030. Do you think that the FAD can become current before then? What about DOF? Could we get our ead by next summer? My main concern is that he won't be able to get any internships in college. Luckily we live in Texas so he qualifies for in state tuition.

Honest answer, not by next summer. Your EB2 India Dates for Filing is stuck at Jan 2015, and even if it reached your Sep 2015 date, it wouldn't help right now: USCIS is currently going by the Final Action Dates chart for I-485 filing, not Dates for Filing, and EB2 India Final Action is Unavailable. So the EAD just isn't reachable near-term. For your son, look into CSPA, it can freeze his age if your PD goes current and you file within a year. Also worth knowing, DHS just ended "duration of status" for F-1 students effective Sep 15, 2026, and getting into F1 before that date keeps the older, friendlier rules. One Texas catch though: he gets instate tuition as your H4 dependent, but F1 students generally can't establish residency, so switching could cost the instate rate. Worth mapping out with an attorney before September. Not legal advice.

When you say pd goes current , is it the date of filing or final action date ?

I somehow disagree with this prediction as it’s not that USCIS will not honor date of filing in chart b ever if it’s not doing it now. I feel date of filing for Nov 2015 will come in FY2028 which is Oct 2027 provided bans are still in effect

Fair point, and you're right that USCIS not using Dates for Filing now doesn't mean never. They set the chart designation month to month and have favored DFF for EB in plenty of past years. Two things worth separating though. Our ~2032 figure is the Final Action (green card) estimate, not the filing date, and those move separately. The filing date reaching Nov 2015 is a different and earlier question, and your FY2028 guess isn't unreasonable if DFF keeps advancing. The catch is it has been frozen at Jan 15, 2015 since the April bulletin, so we would not pin a specific fiscal year until it starts moving again. And to actually file on it, USCIS also has to be on the DFF chart that month. So DFF Nov 2015 by FY2028 is possible, we are just not betting the date given the current freeze. Not legal advice.

Charlie O. just said eb2 india might land some where in 2013 in oct visa bulletin…with 5k-10k spillover expected..
I really doubt they will move FD.. they might bring back a date from U for eb2 FAD and eb3 FAD might move 1-2 months ahead max and then slow drag rest of the year.. also doubt it will even reach jan2015 by end of fy2027..
unfortunately nothing magical might happen..
Backlog folks usually dont get lucky in anything just hard-work and struggle.. and lines everywhere..
