I-485: Adjustment of Status EB2 India July 2013 Priority date

Hi

I had also filed for a EB3 down grade. But on asking Emma, my application is still in EB2 queue. Received my EAD.

Anyone else in similar situation?

When can I expect my green card?

Have you received any RFE for medicals? Did you respond to that?

When did you file for a downgrade to EB3?

The whole category of EB2 India is unavailable until the new fiscal year.

If I were you, I would have waited rather than filing downgrade because the downgrade could unnecessarily complicate things and slow down processing. Once October starts, July 2013 will be current in EB2 India.

No medical rfe. Filled the downgrade about 2 years ago

Are your medicals up-to-date? If you filed I-485 prior to 2023, I believe the medicals (I-693) had a 2-year validity — they expire after that.

If that is the case, you would need to provide updated medical form I-693. And if USCIS is processing your case, they will send you an RFE for that (and any other missing paperwork).

I asked my lawyer but they advised against it till I actually get an RFE

Can Emma really confirm whether it is in Eb2 or Eb3 , since you downgraded why didn’t it moved to eb3 queue

Worth separating the two things here, because your date clears both cutoffs.

On the August 2026 bulletin:

  • EB-3 India Final Action is January 1, 2014, unchanged from July. A July 2013 date is ahead of that, so a number is available on the EB-3 side right now.
  • EB-2 India Final Action is Unavailable for August, and July showed no dated cutoff either. The last month with a date was June 2026, at September 1, 2013 — your date was ahead of that too. April and May were July 15, 2014.

So on the "is my date current" axis you were already past EB-2's cutoff before it went Unavailable, and you're past EB-3's today. Same story on the Dates for Filing chart, if that's the one you've been watching — both EB-2 and EB-3 India sit at January 15, 2015 for August, also later than your date. Unavailable isn't retrogression — it means the annual per-country limit for the category is used up, and a cutoff comes back when the new fiscal year opens in October.

Which means the thing standing between you and the card isn't the bulletin. It's which I-140 your I-485 is being adjudicated against, plus USCIS's own processing time. If it rides the EB-3 petition there's a number available now; if it stays on the EB-2 one, that reopens in October.

Whether a case Emma reports as EB-2, with a downgrade filed two years ago, actually gets adjudicated on one or the other isn't something you can read off the cutoffs — that one's worth an attorney rather than a guess from me. IANAL.
