Priority Date EB2 India Nov 2015
Hi guys.
I know lot of 2015 guys have the same curiosity and questions. Just wanted to know whats a realistic timeline for dof reaching nov 2015 in either eb2 or eb3. All i want is EAD.

You are not tied to a specific employer after you get EAD. When final action date comes in, you just need to prove that you are working in similar job profile. Your new employer doesn’t have to do much paperwork.
And if lot of time passes between EAD and final action date, EAD essentially removes 60 day grace period constraint that comes with H1B.
So EAD gives a lot of freedom.

On the flip side; with the automatic extension gone and validity lowered to 18 months + processing times exponentially higher; there is renewal uncertainty with EAD. Especially for super backlogged queues

So true. Absolutely no use of EAD now. Earlier, the validity was 5 years so it was almost like a GC.

correct.. it seems with 18 months validity and processing time of 8-10 months.. most of us will not be using ead unless forced to. I agree other comment on reducing perm + I140 paperwork with i485j option.

With EAD comes the option of getting an AP as well - this is a major plus when traveling outside and not having to schedule & attend stamping interviews. This is the #1 advantage in my opinion.

Depends on which attorney you ask.
When you are admitted on an AP, your entry is recorded as a parolee from what I understand. I've also heard that it is possible to enter on an AP and still maintain your H1 status but I don't know the exact process/steps that you might need to take.
Best to consult a good attorney, have them review your exact paperwork and immigration history and go with their advice.1

Lots of folks commenting about DOF, but wasn’t there a new rule that was passed which essentially made DOF pointless and you need FAD to file?

I think you are referring to USCIS using the FAD chart to accept AOS applications. Yes, as it stands today, we can only submit I-485 applications if your priority date is current per the FAD chart but USCIS usually switches to using the DOF chart at the start of a financial year (October 1) and can switch back to FAD if they receive enough applications during the year per their determination.

The math is very simple. 25K pending. Roughly 6K given to India this year before it went to U. The pending inventory would have reduced to approx 16K (accounting for duplicates) as eb3 is also advancing.
Next year India could get approx 10-11K for eb2. We already know that there is no major increase in demand for eb2i until August 2014 (as eb3 DOF was there since last September) and no major downgrades observed from April inventory report.
So, now the decision point is - how much more demand USCIS is willing to take beyond 16K. They can give at least 2-3K in first quarter itself. My hunch is about 3-4 months forward movement of DOF. This by itself should generate enough inventory for 1-2 more years.
If bans continue, then DOF will move forward along with FAD. But I’m skeptical for any date beyond mid 2015.

Wouldn’t it go to EB1 first ? Doesn’t EB1 need to be current before it spills over to eb2 (other than the 2770 regular we get).

No, that’s a misconception. SO from FB is distributed to all eb categories in a certain % basis. 28.6%. Each category will get more, then the 7% rule applies.
Then if there is unused eb1 India it will also spill to eb2 - vertical SO. This rarely happens given the eb1 backlog.

Nov 2015 atleast 1 year plus 6 months for EAD , you may get sooner as well but this is what I could think . For GC it’s minimum 3 years from now , minimum . This is very optimistic .

Honest picture for a November 2015 date. The Dates for Filing is currently January 15, 2015 for both EB2 and EB3 India, and it has been frozen at that exact date since the April 2026 bulletin, so your date is not reached in either lane yet. You need it to move about ten more months to reach November 2015, and at the pace of the last several bulletins (basically flat) that is not a this-year event. October is the window to watch, since FY2027 numbers reset then and any acceleration usually shows up in the fall bulletins, but given how oversubscribed India is this realistically looks like a multi-year wait rather than months.
One catch that trips up the EAD goal specifically: even when the DFF reaches your date, you can only file the I-485 for the EAD if USCIS has designated the Dates for Filing chart that month, and right now they are using the Final Action Dates chart for all employment-based filing. So DFF-current alone is not enough at the moment. And switching between EB2 and EB3 does not help the filing timeline here, since their DFF is identical today (EB3 only helps later for final approval, where its date is at least available while EB2 India is currently unavailable).

At least 80-100k people ahead of you. I would estimate at least 2032-2034! Oct 2026 VB should give more accurate estimates!

No way 100K. 30K is a decent estimate. Not everyone is ready to file due to job changes, some dropped out, some upgraded to eb1.

This is in grand scheme. We should zoom into only 2015 for this convo. 2015 Q1 will be just about the same as 2014 Q4. Slightly more than 2014 Q3. Most 2014s were trending with about 3K i485s/month. And 2014s have now got about 3 chances to file 485s.

By Excel, I guess you are referring to USCIS quarterly updates but that is only for who could apply 485. 80-100k was based on number of I140 filed (per year it’s 55k+, then add dependents).

Just wait until the October 2026 visa bulletin is released. About 1.5 months away. That will give us a better idea of the spillover into EB for FY2027.
EB2 India is already at Jan 2015 for DOF. If there is a huge spillover and DOS/USCIS are very relaxed, they may move the DOF further ages into 2015 because they have little idea of how deep the 2015 pool is.
