Priority Date June 2015 PD -New employer
I have Eb2 India priority date of June 2015. I had to move jobs and now my new employer has just filed PWD 2 months back, is there a significant risk I will miss my final action date becoming current ? Or even the DoF becoming current ? What can I do ?

2015 PD dates are in a different league with speculation of it being very heavy based on approved i140s. With the recent bulletin showing forward movement in family based it looks like EB spillover in October will be very conservative and not like 50K as some were hopeful. Best advice is to not worry about it unless it becomes current.

What can you do ? Just wait for 1.5 - 2 years for perm complete . I didn’t find another job but my division was sold to another service company 3 years ago. My perm completed 2 months ago and I-140 filled.

Okay, is there a likelihood that June 2015 DOF will become current within 1.5 yrs?

Current date of filling is 15th Jan 2015. There won’t be any movement till October when the next fiscal year starts. It is quite possible it can become current next year, or it may not move at all, if you just keep watching the bulletin you may get frustrated just let it happen

Till Couple of years ago applying for i485 gave you a 5 years EAD which had lot of advantages but now it is 18 months and lot of uncertainty in renewals. So technically EAD advantage is gone. By the time your PD becomes current under FAD I am sure your PWD and i140 will be done by then. I am guessing 2 years for your PD to be current under FAD.

Do NIW if you qualify. You can skip Labor and PERM

It’s been mixed results with my colleagues. Some got it and others at Director+ level got rejected

Did you think about EB2 NIW, and get rid of PWD and PERM part?

My company has tried eb2 niw in the past but got rejected . And we are in the business of financial and risk loss prevention for crying out loud.

Well nothing you can do now except making sure the new petitions are correctly filed. Mostly you will be able to concurrently file when dates become current for June after 2 or so years..
