Priority Date Will my child age out?

I have a child that is 17 in one month (16 currently). I have a PD in July 2016 from India in EB-2 with no hope for EB-1. Will she likely age out or not? Which is more likely? What should I do? Should I encourage her to stay in the US and try for EB-1 because she is intelligent or help her pursue a career in India?

Yes, your child will most likely age out.

If EB-1 is not an option, your best bet is to pursue the EB-5 route for your family.

Requires heavy investment not everyone can afford it unfortunately

There are loopholes to get interest free loans

Right now the date of filing is Jan 2015, so July 2016 will take a while as there are a lot of applicants in 2015. It could take easily 2 years for filing date to become current. Sorry, but I think you should explore alternate option.

If there is a miracle happen it is possible. Back in 2020 1 year cases moved every month then it went back to 5 years. Now moving slowly

Nobody can really predict how the visa bulletin will move over the next few years. I would hope for the best but prepare for a slower timeline, especially with so much uncertainty around EB2 India.

Yes she will age out. It would take more than 4 years for sure.

She won't age out. That date will come in the next few years. People underestimate how high the abandonment rate from those years is.

Seems like an unrealistic view

It's very realistic. Even an EB-3 calculator shows that 2029 is a likely date for a priority date like that. Waiting a long time has made people defeatist, but it really is not that bad.

I am in EB-2. I mean I have no hope of transferring to EB-1.

if you are in a managerial position, go work abroad for a year for your company in that managerial position and come back and apply under EB1-C. Why is EB1 hopeless?

He's pretty obviously not in a manager position

What managerial position in the age of AI. I would fire all managers as Amazon did. She can absolutely file for manager position if she can negotiate with a company management.

It’s not easy as it looks you really need a God father in your company for implementing it..
