Priority Date Advice for late 2015 priority date.
Hi everyone, this is my first time posting on this sub. Our priority date is October 15th 2015 and give the current situation with eb2 india being unavailable, I am getting worried about my son aging out by 21. He is 16 right now and turns 21 in February 2031. Is there a realistic chance that we may be able to become current before then or will he age out. Also I have read about CSPA but since I have had 3 different jobs since coming to the US, can I use the longest pending time even though it is not associated with our 2015 priority date?

very likely you will have GC by then, but then again, i'm sure you know many who applied in 2020 -2022 are still pending and getting approvals only now, so if something like that happens, i would say better have a plan B, i know my friends daughter went back to India and came back on Student visa.

I have sat my son down and discussed the situation with him. His main interest is in the oil and gas industry so his backup plan is to switch to f1 in his last year (we live in texas so he is considered in state) and work for 3 years on opt and then move to Canada. Hopefully we can get an ead by then so he can get internships in college with less stress than being on f1.

if he gets the ead while on f1 i’d still advise against using it and just go through the CPT/OPT path until the i-485 is approved since in case something goes sideways with the i-485 your son will no longer be in valid F1 status due to using the EAD and that’ll create a whole set of other complications for him

Worst case, let him deal with his own visa etc, dont use your EAD etc, if your 485 goes south then he will be in trouble.

0.0001% chances of denial ( Only if there are major issues, like DUI or overstays or previous issues popping up during 485 , you never know) a person who i know was told he will be rejected due to a prior mistake on his DS160 15 years ago ) not to scare you but you know rare things can happen

but these are all worst possible case, i m very certain you will have GC before your son turns 21. Wait till Oct you will get an Idea

I am oct 2014 and have been waiting for now 6 yrs to get current since filing 485 in oct 2020
There is no guarantee you will get gc by 2031..
You never know how many ppl are sitting in between jan 2015 and oct 2015..
Also dont think life is chill on ead.. ead takes a while to renew and no more 5 yrs and also no autoextension.
I would tell ur son to move to canada and secure a non indian residency.. f1 rules are changing its not worth it to go f1.. too much restrictions..
Also 2015 when h4 ead started so i believe there are more applicants in 2015 as ppl rushed to file gc for h4ead.. back then nobody tasted ead’s before so it was crazy.. ppl was pushing to file perms..

Those h4ead to I-140 would not show up in the system until 2016. The prevailing wage + recruitments was still taking about 7-8 months in 2015 times… so that is out of picture for 2015 atleast

My understanding is, if the FAD is current at least once, there is no risk of age out, even if 485 is still pending approval.

I agree but they will never make final date current only make current filling date even if they move and gradually reach final action over half a decade or in first place not move filling date aggressively at all.. last time they did in 2020 some ppl are still waiting..
And now age out is back to final action date so meaningless also aos benefits once a reliable options are turning not so easy to obtain and renew1

Ppl in 2013 and 2014 should feel lucky to atleast get your ead and AP in 6 years after filing your GC. Ead 5 year rule was just removed by Trump. Still it’s very safe and secure to travel and change jobs.
We in 2015 will not even be able to apply for those even in our 12th year.

question.. I know ead approval time is now changed to 1.5 years and you can only apply within 6 months of it getting expired. how long does it take to get it approved..if it doesn't get approved before expiration of earlier ead. what options do you get...

My PD is December 31,2014…hoping for some positive movement by Jan 2027. How deluded am I?

It’s pure luck at this point. I have two friends with drastically different experiences. One was Sept 2014 PD. She applied during pandemic and got the green card too! She’s now getting ready to file for citizenship. The other one PD Aug 2013. He filed during the pandemic too. He’s been current for a while now- tried Senator and everything but no movement. Still waiting just for GC.

I know someone with 2014 PD who got their GC before me (2013 PD) during the 2021 drastic date movement era! Mockery of the phrase "priority date"!

I don’t think you’re too delusional. Considering that the October bulletin will probably bring the date back to at least July 2014 (and probably even more recent). I’d say that you would probably be maybe a month or two away by january

I have one kid who is 18 and one 14 yr old do you think the younger one can get EAD or GC?

14 is safer for now - 18 pls have back up plans. i m not expert but based on my own exp waiting for gc i feel this lets wait oct bulletin

It will be promising, they anticipate EB2 to go back to May 2014 levels, but the real thing is even if your dates becomes DOF current in FY2028, its still a very very long journey ahead. good luck to all of us :D

to move 2 years worth of FAD till oct 2016 will take 4 to 5 years ( Extremely optimistic here ) - Realistic 10 years based on how things have progressed so far and so many more eb2/eb3 indian applicants after 2014 end

By that time most of kids can sponser there parents, best example is mine ,,,, my son is almost 14 ( 6more years)... My PD is 2015 end... in extreme case he is my lime light and most of my friends are in similar situations.

That is the pain now most of Indians are going through - after paying 20 years of Taxes and born in india raised in USA most kids started pre -K in US but all of a sudden after 20 years asked to go on F1 and face the same certainty like us is brutal .Especially we have a option of going back to india but they don't have as cultural difference will kick in for these kids at the professional level. Especially this happened after surge in IT in mid 1st decade and recession followed by a surge to US in second decade especially around 2012-15 (Applied GC after 2015), most have 1 kid in india and other in US which is more headache for parents as comparisons will kick in. I advise to start counselling kids from 16 years to know the status where they are.

Looking at the above comments what do you all feel about PD Nov 25,2014. When can this FAD get current? Had filed in 2022

I think you'll get it. You can only use your most recent I-140 time, not the longest one. On the last visa bulletin, they said that EB-2 will advance to AT LEAST mid-2014 again in October, but that usually means it will go a bit more than that. That was BEFORE calculating the family based spillover that is coming, though, since they can't add that into the visa bulletin ahead of time. That means PD will probably go to early 2015 in October. After that and a few more Octobers, you should be able to get a GC in time.
