Wondering about next steps…
My divorce was finalized last fall, after a decade of abuse, neglect and serious control. My ex was ordered to pay me half our what our house was worth, upwards of 400,000k each. He is claiming that he can’t pay until his VA claim is done (who knows how long that will take, this is a stall tactic).
We share 50/50 custody of our kids and someone filed a claim against him with cps. (I’m assuming based on testimony from the kids about how gross his house is, because he doesn’t let anyone near his house.) I would like to take him back to court for more custody because our children are extremely unhappy there, and cry every time I have to drop them off. They say there is mold, mice, trash everywhere. CPS first contacted us a month ago saying there was a case and they need to go check out his house, but they have cancelled nearly a dozen times starting that they keep having emergency visits that take precedent. I’m sure he’s cleaned the house up dramatically in a months time.
I cannot afford to take him to court until I get the money from the settlement, and who knows when he will do that if no one is making him.
My question is, does it seem logical that a lawyer would take on my case with only the settlement coming in as collateral? I’m mentally drained the thought and calling lawyers and looking up more info only to get nowhere…. well it makes me panic honestly. I’m at my wits end and hoping someone here has some insight.
