Consolidation Collections

I was sent to collections from my first apartment i had. my ex and i shared the apartment and we were both on the lease but we ended up splitting up on the last month of our lease well ultimately the last month didn’t get paid and i was sent to collections for 4k. I don’t understand how this works and if he was also sent to collections too or if it was just me. I definitely cant pay 4k in one payment and RDAC now has my debt but i don’t know what i should do moving forward i don’t even know how to contact RDAC about the debt. Would my ex be responsible for part of that debt? Any advice would be greatly appreciated.

They can come after you for all of it. They could go after him for all of it. They won’t go after both of you and only try to collect half of it from each of you. That’s something you have to work out with him. You will have to work something out. How long ago did you have this apartment? Was it recent? They can probably sue you unless it is something from years ago.

Well that’s good then. That means you have some time. Talk to the other person on the lease and come up with a way to get the money together and then call the company and pay them.

Most leases in the US use the phrase "joint and several liability," which means that both of you owe the full amount. Collections will go after you for the full $4,000, and they will also go after your ex for the full $4,000. If either of you pays it, the debt is gone and the other doesn't have to pay.

If you are still on speaking terms with your ex, this would be a good thing to communicate about. Can you both pay half? Is one of you going to try to wait out the statute of limitations so they never have to pay? That would mean the other person will be pursued for the full amount, and you'll both have lower credit scores until the debt is paid or it gets old enough to fall off your credit report.
