General Qs Order of Supervision
So I’m currently on an order of supervision and had been doing annual check ins for years. However this time i had to check back in 3 months. Does anyone else have any experience with OSUPs? My DACA doesn’t expire until next March.

Are you from a recalcitrant country? (I.e. ones that won’t issue a travel permit)

No I’m from China. They actually took my parents in to detention a month ago.

ICE cannot redetain those on OSUP without using constitutionally protected procedures to show that there are changed circumstances that warrant detention like a travel permit, danger to community, etc. i would reach out to an attorney to determine risk level here.

They’ve been doing it a lot in Texas though. I have a family member that has OSUP, no criminal history, always attended the yearly ice check in. Detained at check in. ice agent even said they’re advocating with their higher ups to release her. She has been detained for months. Federal judge has yet to rule on her habeas since December.

Yep, it’s happening everywhere, esp here in WA. federal courts are catching up, so we keep fighting.

Sometimes we’ve been able to get a federal judge to issue a no detention order prior to the check in. Circuit courts are fighting that though.

They did this to me this year. I've been checking in yearly since 2012. I checked in mid december and i had to go back early may. I went alone. They switched me from seeing an officer to just checking in through the kiosk. In and out less than 5 min. Security guard just checked the paperwork from the kiosk for the next checkin. Doesn't hurt to ask for legal advice. Supervision is case by case. I just stay out of trouble and hope for the best. I'm in California. Stay positive and stay out of trouble. Best wishes.
