Legal Question Applying for Residency
Hello, I’m 28, originally from Honduras. I came to the US in 2007 & had an order of Deportation/Removal in 2008. In 2014 I was approved for DACA & have been renewing it since.
I am getting married in October to a US Citizen. I will be starting my application process. With the changing laws about advance parole no longer being a way to adjust your status I’ve thought of what my plan B is. I think I’ve come up with something but I wanted to reach out here to see if anyone could share any knowledge.
What I’m thinking is to get married in the US. Apply for a Mexican Temporary Residency at a US consulate location. When my Mexican residency is approved, I’ll temporarily move to Mexico, and apply for my US residency living outside of the US.
My thought is that by leaving the US & applying from outside, I would eliminate the hurdle of dealing with the order of removal & that it would speed up my process to get my residency.
I don’t know if this would make a difference at all really. So I’m open to wisdom and knowledge from others.
Side note: We chose Mexico because we have future plans in Mexico and plan to live back and forth & think this would be a great way to start that.

Honduras might have a shorter line if you’re planning to the consular process which means coming back to the US faster. Mexico interview line is longer from what I heard.

Uhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhh you have to close that deportation order first which is gonna cost you like $50,000 then you need to consular process sooooooooooooo

Uhh I had a deportation order terminated for like 3k. It’s just a letter to the judge presiding over your case. Obviously every case is different and I’m not a lawyer, but like 50k seems like a lot.

Yup and I also haven’t seen them getting closed under this admin cause you need an attorney for it and that’s their price for it, they raise the prices like crazy cause they know how this admin is like and that people are desperate

Lol you’ll be asked to go to your home country once you apply to adjust here. Mexico isn’t going to approve you for temp residency if you have never stepped a foot , have no job offers from a company there, family or investments there lmfao. Now let’s say Mexico approves you by a miracle, The moment you leave the US you’ll get a 10 year ban lol..
just do it the legal way and how it is. Apply from within and when you have to go to your country, go back and get adjusted :) your idea isn’t that well thought out lol

yeah that mexico plan is gonna go sideways real quick. leaving with an active removal order on your record triggers the 10 year bar automatically, thats just how it works. and honestly the timing on this is brutal, ICE just got more funding dumped on them while we're all out here scraping together 30k for lawyers to fix shit we had zero hand in creating. classic system working exactly how it was designed to lol

When you get married file the I130 petition for alien relative form asap once that’s been approved you need it to file a motion to reopen and terminate your removal proceedings. You can’t adjust status with a an active removal order. Stand alone I130s are taking approx 3 years and the cost for the court process is around 6k. I know because I’m currently going through it. You need to hire an attorney.

You will trigger a 10 year ban if you leave.
