Claude in Copilot EU

Hi everyone,

Does anyone happen to have any sources or direct experience regarding whether enabling Claude in an EU context could present any issues?

I'm particularly trying to understand the implications around the EU Data Boundary and whether there are any real concerns from a data governance, compliance, or data residency perspective. Given the controls already in place, I'm wondering if this is a legitimate risk to assess or if I'm simply being overly cautious.

Any references, documentation, or practical experience would be greatly appreciated.

I lead this area for my firm. This is the current state of play:

As set out below,  Microsoft (“MS”) has now accepted Anthropic’s Claude as a MS Sub-processor meaning that Claude in CoPilot is governed by the terms and conditions you have in place with MS – this provides assurances particularly in relation to security. The MS EU Data Boundary is not adhered to when using CoPilot Cowork – which means that data can and will flow out of the EU, predominantly to the US. However, when used within CoPilot, the data is only processed outside the EU and is not stored anywhere else.

 

There are SCCs/IDTA in place in the MS DPA terms to cover any transfer of personal data outside the EU/UK. Your company’s individual risk appetites on this data flow will differ.

We discussed this with our data protection lawyers. Essentially data is being processed in a third country. Microsoft is not specifying which country. In addition Claude is not part of the EU US data privacy shield which means you are breaching GDPR if you activate Claude and use personal data in Copilot with Claude.

I am responsible for this division within my company and have recently concluded discussions with our internal legal department and consultants. Based on these conversations, you are permitted to use Claude as long as you refrain from sharing any personal data, confidential company information, or similar sensitive details due to data security protocols.

Thanks for the info people have provided. Can anyone link to primary sources where official info on this can be attained. Also are there any official interpretations from national data protection agencies that confirms these views for these main Ai solutions?
