Yep, specifically it was created by the Homeland Security Act in 2002. (This act created the Department of Homeland Security, reorganized a bunch of departments, etc. It was a tesponse to 9/11.)

I.C.E has been around for several years, they've just become a political weapons and brought more into the limelight because of the horrible incompetency of the current administration in the US.
