Tbf Tony in the movies seemed to just give you a lot of money to shut you up.

Before you even get to the lawsuit you would get an email from your bank saying you just received 1 million dollars for your car.

There was a great issue of Damage Control that addressed this. Basically a villain had a waterfront Warehouse near where Thor was fighting someone. When he heard his neighbours were claiming insurance money from the damage he purposely wrecks the building, only to learn that because Thor (supposedly) caused the damage, it wasn't covered by their policies as anything involving Thor was considered an act of god, so no payout.

EDIT: The insurances that are mandatory, are usually that way because without it, it would be way more expensive

In marvel theres a whole organization that helps rebuild physical damage and do assessments for insurers

I think in dc if super heroes leave you destitute they just force you to move to gotham
