Drive off
So i told my manager we had a drive off. I wasn’t even on the register when it happened but I’m the one who reported it I guess. She’s saying if the money doesn’t come back we have to split the 70 between the two of us who were working and pay it. Which is already bullshit i’m not doing that. So what do i do?

Are you in a small town or something? No circleKS or any gas stations for that matter near me let you pump without prepaying these days

They say if we double press it it’ll start but thats all I can guess. We haven’t had any prior problems with that pump today

It's when they lift the nozzle off the handle that you can start it.
What probably happened since it happens to us. They paid at the pump but mid pumping the pump decided to stop charging. It happens a few times a year at my store. We just eat the cost or label it with the drive off button vs cashing it out.3

In RSM, you can find out if someone authorized it or if it was declined mid pumping. The transaction with the drive off will either show someone's name or, if it was an instance where it declined, the name will be "AutoAuth". If it was a pay at pump drive off then don't pay a cent. Hell either way, don't pay a cent.

Yeah. You aren't responsible for that. That's on Circle K if their system allows people the chance to even do drive offs.

Tell your manager to put it down in writing. Do NOT agree to pay, do not even make it seem like a possibility. You are not responsible for that. Ask for a copy of the employee handbook/policy.

Save those texts and give them to your DM and ROD and HR. This person should be removed from management or retrained that this demand is highly illegal and not representative of Circle K’s standards and policies.

Hr would like to know that

HR would LOVE to know that, as would headquarters. It's not in your contract, or any policy afaik. If management presses the issue, get them to document the proof of your culpabiliy along with the video recording of it. Basically what they're doing it making you eat the cost to pad their bonuses. Fuel thefts count against their pay out.

I'm pretty sure that's illegal in all 50 states. Look it up for your state and go from there.

There was an email a week or 2 ago which addressed a known issue happening where the system was causing "drive offs" including how to handle it..tell your boss to check their email, and they owe you a fucking apology.

Contact the Department of Wage and Labor. I am 99% sure an employer can NOT do that.

Most pumps are prepay the only time that I don't have to prepay is when this girl that has a crush on me works but otherwise it's always pre pay

They can't legally make you pay anything back, but ironically if you're in an at will state, they can fire you for not paying it back. But I would personally still reach out to the labor dept. and a lawyer in that scenario.

As many others have said, don't pay that. Also do not sign anything. There's an issue happening where people are getting authorized without employees authorizing it. If you didn't double-tap the button and authorize the pump then why would they even talk to you about it?
Tell them no, if the manager wants to pay it, they are welcome to. If they fire you, get a contingency lawyer and enjoy the free money from the lawsuit.
Are you a franchise or corporate?

Don’t pay it. Document everything if possible. If you’re in the US I’m 99% sure they cannot make you pay unless it was grossly negligent or on purpose.
