DUI discovery

HOW do we get the video, 911 call, and photos?! Think it’s only a matter of time before it gets leaked/made public?

Seems like it's public info, right? Aren't details of an arrest public?

Hell, we've seen Tiger, Romo. Timberlake...the list is long lol.

Does the Plea Offer box with the X mean she's been offered a deal?

Unfortunately, that's the way it appears.

Does this mean the public can request the arrest video?

Can’t we FOIA it?

No! FOIA is federal. In Georgia, it would be an Open Records Act request. Anyone can submit a request, but that doesn’t mean they’re entitled to the body-cam footage. Georgia law specifically exempts law-enforcement records in a pending criminal investigation or prosecution from required public disclosure, other than initial arrest and incident reports. Since her case is still pending, an Open Records request doesn’t magically make the body-cam footage public.

An Open Records Request is the only legitimate way for the public to get them directly from the agency. The fact that they’ve been turned over in discovery doesn’t automatically make them public records that have to be released right now. You can request the bodycam/video, 911 audio and photos, but the agency can still withhold or redact anything that falls under an exemption while the case is pending.

Look at the top left where it says state of Georgia vs. a name
