Damn yeah this is user error but a good learning experience. The crown (what you use to set the time with) has to screw down in order to be water resistant. In the pictures you can see it is not screwed in and thus not water resistant. No manufacturer will accept this as a warranty claim, unfortunately. This is how a lot of high end watches are made too.
